Did he live with you more than half the year, or if not is there a court order that you can claim him as a dependent? If neither of these is true, then you don't need it to file your taxes because you are not entitled to claim him, even if you paid child support.
If he lives with you, or you have a court order that you can claim him, talk to your local social security office about how to get a new card. You should also be able to find the number on past tax returns if you claimed him before. |

First off, if your allowed to claim your child this year don't think getting the SSN will be easy if she will not give it to you. Even if you have a copy or the original of the birth record you still CAN NOT get a card for the child. I recently learned that a birth record is not a valid form of I.D. for a three year old...
In order to get a social security card or just the number for a minor child that does not have a drivers licence you must have a written note from his or her doctor (usually they ask it be a shot record) but the doctor also has to sign it, stamp it and get it blessed by God himself for them to accept it. It took me three tries and three different doctor notes to satisfy the SSA that my child was indeed who I said she was, the kicker is I already knew her SSN I just never received the original card...
The best thing to do is go to his doctors office, Ask for a copy of the hand written shot record they have in their file, have the doctor stamp it as a "Official copy" then sign it. Then also ask that they print a copy of his shot record off the state database (States have databases that doctors report shot records too) Have the doctor also sign an stamp that copy as a "Official copy". Then while your there get your son a physical if he hasn't had one in the last 90 days. If he has GREAT! Have the doc sign, stamp and date the physical report... (Make sure all three items have the doctors office name, number and information on them) Then walk your happy butt to the SSA and hand it all to them. They will then and only then issue you a new card for him and if your lucky and ask nicely they might tell you his number at that moment if you can answer a bunch or whats your great-great grandmothers, uncles, mom's maiden name questions...... So you can then run home and file your taxes. In 3-6 week you will receive the new social security card then in another 3-6 weeks you will receive a letter from the IRS stating you have to pay back the amount you were not entitled to by claiming him when someone else already has, plus the additional fines and possibly face jail time for fraud.
In other words don't chance it, even if you think it's your year to claim him. Call the IRS first and explain the situation. See if they can check to see if she claimed him (after you get the SSN of course) and if so get a copy of your court agreement stating who claims him even years and who claims him on the odd years then forward it to the IRS's fraud department. If you file him on your return after she has filed there will just be a huge delay for both parties involved. Nip the problem in the butt now! Don't file yet or if you know for a fact she claimed him you can file without claiming him and amend it later. I've seen it happen to my brother when it was his year to claim the child and his ex went ahead and claimed her anyways. Either way if she is in the wrong she will get what she deserves. But doing it in the above manner will avoid the delay in your return and they will know what’s going on. They won't have to fumble for months to find out who did what wrong..... If you do not have a agreement on who claims the child then the child is to be claimed by the person it resides with the majority of the time. So whoever has him for over six months and one day out of the year.....
Also a helpful hint to keep in mind... If the mother has custody and you were to ever take the child for a extended summer visit or something to that effect and you have the child for 7 consecutive nights that you get a certain percentage (usually around 75%) of your child support back if you file the correct form with the court just after the extended stay.
P.S. I get three thumbs down for giving the best, user friendly, straight to the point, way to avoid troubles an delay, only way there is to get a new card (without a picture I.D. of the child) answer? How cute! I guess people must like screwing around with eveything that isn't going to work just looking for that easy short cut. Let me know how much time gets wasted with that.
I actually just came back to add the fact that if you have ever claimed the child in a prior year that his SSN will be on the copy of the tax papers you should have kept for your records. If you didn't keep a copy, lost it or for whatever reason no longer have it and you had them done somewhere such as H&R Block, Jackson Hewitt, or even Turbo Tax online you can just go to them or the site and request a copy of the return you filed for that year. His SSN will then be right there in front of you! You also might look to see if you could get a copy from the IRS, maybe on the website even...
