you would have to be married during the year of the tax you are filing for. even if married on december 31 2007 the taxes you file by april 15 2008 is for 2007 so you can claim your spouse since you were married in 2007

Spouses technically aren't "claimed" like other dependents on a tax return but.......

As long as you are legally married by 12/31, you are considered married the entire year and you can file your return as "Married-Filling Jointly" or "Married-Filing Separately" (Jointly is usually better).

If you are officially married in the last minute on 12/31 of the year you are considered to have been married all that year.

The technical answer is that you can NEVER claim the spouse as a dependent.

But I know, that's not what you are asking. If you are married as of 12/31 of the tax year, you can file a joint return for that year and claim an exemption for each of you.

Even if you get married on December 31, 2007, your filing status will be Married Filing Jointly or Married Filing Separately.
You don't claim spouse on you tax return. Your filing status changes.

Fojimo explained it best. Half my family works with taxes professionally and he's the first one that's 100% right. You can go get a publication 17 from www.irs.gov and that will explain it. it's under forms and publications

As long as you're married before the year that you're filing on you should be fine
