How soon can I file my taxes if I won't make any more money in 2008?
I have a situation where I need to file my taxes literally AS SOON AS POSSIBLE. I mean, even before 1/1/09, if possible with my last stub. I am trying to get my employer to give me my W-2 immediately, but may not happen soon enough. Otherwise, I plan on using my last check stub for the information to file online. I already have the employer ID from last year's W-2, so the rest should be on my stub.

As I said, I plan on filing ONLINE. So, rules for mailed returns don't apply.

No earlier than Jan 1st for mailed returns. If if arrives at the IRS prior to Jan 1st, it will normally be returned.

The IRS doesn't even start processing ANY 2008 returns until Jan 16th, and Jan 16th is the earliest date for e-filing returns for 2008.

You can NOT legally use your final pay stub to file a return. If there are ANY differences between what you filed and your W-2, you MUST file an amended return. That's painful, and expensive if you wind up paying someone else to prepare it for you.

Don't assume that your employer's EIN will be the same this year! If there was a change in corporate ownership, even though the trading name of the business didn't change, the EIN will change. If you file with an invalid EIN, your return will be rejected. Corporate mergers, acquisitions, divestitures, and reorganizations can also result in EIN changes. I worked for a Fortune 300 corp a couple of years ago that had over 100 EINs.

Edit: Your assumption that the rules are different for e-filed returns is WRONG. You MUST have a W-2 IN HAND to file a LEGAL tax return. So many folks screw this up every year that I expect the IRS will eventually start imposing a stiff admin penalty for filing a fraudulent return, similar to the $500 penalty for filing a fraudulent W-4.

You NEVER file from your paycheck stub.

1. The employer ID can change.
2. You will find the W-2 doesn't always match the last paycheck stub.
3. No legitimate preparer will file for you because if caught, they can be kicked out of the efile program.
4. If you do it anyway and get something wrong, you get to file a 1040X. Those are a pain to do and tax 8-12 weeks to process in a good year.

Fortunately, the IRS won't even accept an efiled return until 1/16.

PS, I too would expect the IRS to start imposting a $500 penalty--to cover the nuisance cost.

The return won't get processed any earlier just because you file it sooner.

January 1. You have to have your w-2 and employers are not required to get them to you until the end of january. Sometimes they can come as late as the 15th of february if they were at least postmarked on time. Many other forms such as mortgage interest statements usually don't arrive until the very last day of january.

ETA: oh.. online only? then as the others have said- january 16th. and yep, EIN numbers change all of the time as do company addresses. you have to wait for your w-2

Either way you must have your W-2 first. Filing from pay stubs is asking for grief and expense.

January 16th is the earliest for electronic returns.

A tax preparing service will not start preparing your taxes until 2 Jan, and even though they can submit it, IRS will not start accepting til 16 Jan.
The only way to use pay stubs is if you have not received a W-2 by 15 Feb, have to include information that employer can not or will not provide W-2, and what action you took to try to obtain W-2.

A tax prep service will need your W-2.

You can not e file your return before january 1st. Believe me I already tried.
