It's my ex's year to claim our son on his taxes. Hes several thousands of dollars behind on child support. Has been for several years now. I know that anything more than $500 behind, and the IRS is supposed to have his refund offset to pay his back support. However, in the past, even though they were supposed to, they never did! This includes his stimulus pmnt last year... for which he collected an extra $300 for our son!!! Our custody agreement has him claim every two years... and then it's my turn.
I've contacted my local Child Support agency, and the nasty woman on the phone basically told me there's nothing I can do to ensure that the govt. will intercept his refund. She just kept saying over and over that it's automatically done! Well, it failed in the past, so i want to do whatever I can to make sure it doesn't fail this year!
My question... who do I talk to?? What number do I call??? To make some one pay attention, and give a crap about my case, and make sure he's put on the damn list!!!!! Additional Details **DOES anyone have a working phone mumber for the IRS?? even the ones H&R Block gave me dont work. or they're automated prompts with no inclusion of my situation.****** |

It sucks doesn't it!?! You must not receive any public assistance. It seems like for Ohio CSEA agencies to do anything, you must be receiving a welfare check! Only my opinion of course. Unfortunately there isn't much you can do. Are you sure he is even filing his tax return? (That's my son's father's trick. If he doesn't file... they can't take it!) What you can do is re-read your custody agreement. Usually, there is a clause in there that says in order for him to claim the child, his support must be current as of 12/31. If your order does not contain this clause, you should head to family court to see if it can be added. Also, I don't know what your income is, but your son's father can only legally claim the exemption for your son. In order to get the earned income credit or to use the dependent to qualify for head of household, the child has to live with you for at least 6 months & receive 50% of his/her support from you. Even if your ex claim's the exemption (child tax credit) you should still be able to claim the child for the earned income credit if you are income eligible. |

This is supposed to be done via the child support office that is managing the case. Do you know if your case is in the enforcement stage? This is typically when they can intercept tax refunds. I would call back and ask to speak w/a supervisor. |

Sorry, but it has to be done locally with that nasty woman. They have start the proceedings that end with the IRS and usually your state offsetting his refund. Just see if you can get somebody not so nasty this time! |

Go the IRS yourself and turn him in. Take the documentation of your child support agreement with you, and let them know he's cheating. Then change your locks, because you're going to P*** him off big-time.
Basically, if the governement doesn't care, you can't make them care--but you can keep hounding the IRS about him--and eventually they will get it through their very thick skulls that there is something wrong. That child-support agency is also negligent. Report the case worker to her supervisor and let them know she's been (a) nasty to you and (b) unhelpful. They are monitored for these things.

Get a lawyer. The IRS is worthless. I literally waited on hold with them in regards to a question I had to the 2008 stimulus payment for over 4 hours before anyone answered. Then I found out they direct deposited it into the wrong account. To "track" that and refund me took upwards of 6 months! So get a lawyer to get your child support. You deserve it. A judge will hear your case and garnish his wages if they must. Have it automatically taken from his paycheck if he has a job. Otherwise a judge can at least back him up against a wall and order him to pay. Also he should not be allowed to claim your son as a dependent when it seems he in no way supports him financially. I wouldn't run around for months with the IRS, their main concern is not you or your son. You'll have much better luck in family court. And good luck with everything. |

try contacting your state's attorney general or department of social services.it may be too late to get it for this year but maybe next year.social security numbers have a deadline to be flagged by 12/31 of the previous year to be flagged for tax offset.
cocoa A is correct also you should try calling the child support agency back (do you have a worker with them)and demand that his social security number gets flagged. |

I'm really afraid there is nothing you can do at this point except for waiting. There is a phone number to the IRS to check on offsets to tax refunds, but this is only for the person who has the offset. They would not be able to give you any info.
For the future, if you could possibly do this, is to go back to court and request to have the custody agreement changed due to his back child support.
