How will i file if i get married in August for 2010 Taxes?
This is kind of a long story but here it goes.

OK so i am I a college student and engaged to be married. According to my school I am a dependent of my mother until i am 24 or married. I haven't lived with my mom in 3 yrs and she hasn't claimed me on her taxes for her 2008 taxes, furthermore she didn't file at all for 2009, ( she owes is my guess, but i doubt she will file again next year) and this is hindering my chances for financial aide i couldn't get anything last year i had to take out a student loan and this year was a bunch of paper work and headache.

So my finance and I decided that maybe we should get married in aug just so i can eliminate the need for my mothers taxes and go off of ours, so my question is: if we get married in august, for my 2010 taxes will i file as single because i was single from January until we get married in Aug or do i file as married? I've already called the IRS and she couldn't give me any answers because she said that they are still in 2009 tax year, but the whole point of us getting married earlier than planned is to avoid the need for our parents' taxes for our college schooling.

So if anyone got married Mid year how did u file? or if anyone is in the tax or accounting business can you please give me some insight because I am so tired of jumping through these hoops and i will continue to have to do this for several years and i need to cut out the middleman so to speak.

Although you have a long story, there is only one sentence that matters. If you are married on the last day of the year you file as either married filing jointly or married filing separately.

Your marital status at the end of the year determines your filing status for the entire year. Even if you marry on New Years Eve, you are married for the entire year. As such, your only choices are Married Filing Jointly and Married Filing Separately. Normally MFJ is the preferential way to file.

You must have caught the janitor at the IRS. This is a rudimentary issue that all of their CSRs should be fully versed in. The fact that they are processing tax year 2009 returns at present is irrelevant to your question as that's one of the rules that has been in effect for decades and there is no chance that Congress would change it.

You may be able to obtain financial aid even if your mother does not file and you do not get married. In many cases, financial aid offices will accept a "verification of nonfiling" from the IRS instead of a copy of a tax return.

To answer your question:

If you are still married when the year ends, then you must file as married.
If your spouse dies while married to you, then you must file as married.
You may file as single only you get divorced before the end of the year or get the marriage annuled (at any time).

In all cases, a person is required to file as whatever marital status they had at the end of the year, or at the moment that their spouse died, whichever happens first. It does not matter how long you were married or single; it only matters which you were last. Even if you do not get married until 11:59 p.m. on December 31, you must file as married.
