"Dear Mr. and Mrs. xxxx".
"Please send a copy of your closing paperwork (page 1 of your HUD-1 Form) to the IRS at this address. Failure to comply will mean the elimination of the credit for first time home buyers......"

Obviously, the IRS does not publish what it intends to do but checking this would be quite easy for them. |

Like everything on your tax return - they trust that you put down the truth. Until the audit. Then you pay back everything that you cannot prove to their satisfaction with documentation. So keep your closing papers at least the 15 years that you are paying back the "credit" plus three more years. |

They don't want paperwork from you unless they audit your return. All they have to look at is your tax return. If you start itemizing deductions and show real estate taxes and home mortgage interest on schedule A for this year and you did not have these items in a prior year they have their proof. |

They haven't said how they will verify it, but on the form you have to put the address and date of purchase, and transfers of home ownership is public record. |

Dear sleepy: They WILL know. The IRS is a very sophisticated organization and there are many ways to verify the home purchase. There are controls in their software that assure compliance. I have also found in dealing with these people they are just like us..pretty good people.

In addition to Wayne's comment, there will be other ways too. The IRS can see your past and future tax returns, as well as your W-2s, 1098s, 1099-S, etc. The audits for people who never-bought-a-house-but-say-they-did will go on for years--particularly if the housing associations say that x number got sold and 10 times that show up on the tax return....
Owning a home affects a lot of things.

I would imagine (for people that purchased prior to the effective date - say in 2007) that their system would check for anyone who deducted mortgage interest on a prior return. |

Wayne is correct.
Also keep inmind, because I think a lot of folks overlook this part -is that the credit is really more of a loan. After two years, you start paying it back, a little each year, on the next fifteen tax returns. |
