They will get caught as soon as they buy a house, and they will seriously regret it. They are committing fraud and if the think the IRS will ignore it they are mistaken.
While they usually only have to pay a fine, and it if FAR more then they ripped off, but they could also face prison time if they stole a great deal from the government, or do not pay the fines. |

That's playing with fire. That would almost certainly trigger an audit. The IRS computers cross check things like this. Head of household is for single parents. You file it when you are the sole adult providing a household for kids. If they don't have kids, it would also be a red flag to get audited. You might want to advise your friend to ammend her return or she could get in trouble for fraud. |

They wouldn't! However they have to be careful on how they file for the next few years because it all gets computerized and sooner or later the irs will run it's secret spy audit software and BINGO, out will pop a few names that should be audited! |

If they have the same last name and list the same children (if they have any) on their taxes, it may raise a red flag in the IRS database, especially if there is record of them being married from the previous year at the same address.
If it does, they could be chosen for an audit. But, they would have to detect that in their databse. I'm not exactly sure what the chance are. |

The IRS wouldn't know, as long as they were not claiming the same dependents.. but if they purchase a home together and have interest on a mortgage in both their names in the future, the amount will be reported to the IRS and will raise a red flag. Also, they can't file married filing jointly in the future.. again, this will raise another red flag and they will probably get caught. The penalty of purposely cheating the system is far worse than just making a mistake. I wouldn't go that route if it were me. Best Wishes! |

When (not if) the IRS catches her both she and her husband will be banned from the EIC program for 10 years. Plus they will get to pay back the excess refunds with penalties and interest.
So many people cheat to try and claim EIC that the IRS has to audit virtually everyone who files for it with HOH.
If they file for FASFA or a home mortgage, the lenders will catch it and demand that they immediately file 1040X returns. This is often faster than when the IRS catches it. |

Good question Saram, I have wondered myself. I have seen people file as single or HOH for years when they were married without ever being contacted by the IRS. They are breaking the law however. The law is the law, not "what you can get away with". |
