Of course they will find out! Employers have to make reports to the state of all employee taxes withheld and unemployment tax returns typically require that all employees and their pay be listed.
If he doesn't notify the state that he's got a job he WILL be caught, the only qualifier being "when." At the very least he will have to pay back the excess benefits he received. And if he had signed a report stating that he had not worked or received any pay he could be prosecuted for fraud. That could bring jail time. He could also be barred from any future unemployment claims indefinitely.
So, if you think catching up is tough now, think of how much fun it will be as he pays back the benefits from prison. That will make your current situation look like a walk in the park. |

Tell them NOW.
If he waits until they find out, here's what will happen:
2007 income taxes will include the unemployment compensation. You will pay taxes on it.
2008. EDD finds out and demands repayment.
You repay the difference, let's say $2000.
2008 you go to do your taxes and try to take a deduction for the $2000 you repaid...and discover that you can only take it as an itemized deduction and since you don't itemize, you won't get any money back. |

Aside from everything vb stated.If your husband gets laid off again and you didn't tell EDD he was back at work it could delay or even have them deny benefits. Tell them now. |

Employed persons are not eligible for unemployment benefits. Your husband got what he was entitled to. If he cheats to get more, at best he may have to repay it with interest, at worst he may be subject to criminal penalties. |

First, it's illegal to do what you suggest - I'm sure the rules were explained when he started collecting on what he has to do as soon as he finds a job.
Second, yes they'll find out. And then you'll have yet ANOTHER bill to pay, paying back the illegally obtained unemployment comp.
You wouldn't ask "We're behind on bills - is it OK to go hold up a bank to get the money we need?" What's the difference, really? |

Claim for the periods he doesn't work and not a day longer.
For example, I started a job on say October 1st that pays weekly. I got a paycheck October 5th, then on October 10th I was due to call in a claim. I claimed for everything in September but not October. October 12th I got paid again. October 13th I got my last check in the mail.
The payments may cross but you can't claim UB for a *time* you were available for work.
Call everyone and negotiate pay deals with them. And if you have a number of bills you can't negotiate with, make sure you have savings in place for the same occurrence later on.
Most of the utilities will stretch out payment plans with little or no penalty, maybe a couple of bucks a month in late fees. |

Don't screw with the State!!! Get to the unemployment office or fill out the form supplied to you, to let them know when your husband returned to work. Why would you risk getting into major trouble when he just got his work back. HE'S the one the State will come after, not you, and then he could be looking at permanently loosing his job. |
