If you're not a "full time student" (for 5 months of the year) and earn more than the standard exemption amount ($3400) your parents MAY NOT claim you as dependent. Who may claim your daughter as a dependent is complicated, basically depending (!) on who provided most of her "support". As "support" includes the fair rental value of housing (assuming you don't pay rent to your parents), this becomes complicated.
If you provide over 50% of her support, you may claim her.
If (your parents file a joint return) and THEY provide over 50% of her support, they may claim her.
If no one taxpayer provides over 50% of her support, then all those who provide over 10% need to agree (on a multiple support form) which of them can claim her as a dependent.
The rules for the earned income credit and the child credit may be slightly different, but I haven't researched them after the recent unification.
I would like to coopt and edit some advice from one of the other answers, if I may. If you purchase a tax preparation program, such as TurboTax or TaxCut, you can run the figures both ways if it's a "questionable" matter at no additional cost. A professional tax preparer will usually charge additional fees for alternative calculations. |

You should tell your dad you want to file your own taxes and claim your child as a dependent. If he claims you then you can't claim your child, he would have to take your child as a dependent too. If you support your child then you should be taking credit for it. |

What you and your dad need to decide is who would benefit more from the deduction....
In other words, if he's making $60k and uses you and your baby as a deduction, that could mean an extra $2000.00 on his return. (That's just a made up figure, of course). Whereas if you are making less than $20k and claim the baby and yourself that would mean less of a return. However, if you qualify for Earned Income Credit because of day care expenses your return might be even larger than his.
I would go to one of the tax preparation sites (there are some that will let you do it for free but if you want to file or print your return you have to pay around $30.00) and each of you do it both ways and see who ends up with more money. Whoever gets the most should file that way and both of you can share the difference. |

Since you're employeed he should NOT claim you. You have to file your own taxes and you can file your baby as a dependant and get a decent refund. |

if U R living with your parents and R paying rent to them, or they R NOT providing your full cares..then U claim yourself and your child....but if your dad claims U and your child..he must show proof that U R not paying rent and he is providing FULL care for U and your child.......I would be much better, since U R a working mom, for him NOT to claim U...he could be auditted....usually they over look this IF U R going to college....then NO problem....IF I was your dad...U would be filing your own taxes and claiming your kid...and U will get back more money from the government, especially if U live in the US...$600 for U and $300 for your child.....also file for EIC, use the worksheet and see if ya can get extra money for this...if U don't understand..go to a GOOD tax preparer... |

Do it both ways. If you made enough money to file taxes, then you have to file. However, you can file as single with no dependants and head of household if you made a decent wage. If not, and you can get out of filing them, he can claim you as a dependant, but needs to claim your daughter for the earned income credit. That is where the major money will come from. He can file you as a dependant and you still file as long as you do not file head of household. With your age he cannt get the earned income credit on you though. |

Or do it both ways on paper and see which way gives the greatest return and split the money, |

No he can;t claim you if you are working and able to claim yourself. But he can claim his granddaughter since she living there. Grandparents can claim their grandchildren if they are living their which I think it wrong. I end moving out of my parens because my mom always wanted to claim my two kids on her taxes so she can get more money. I told her no one year and I moved out so I can claim them not her. |
