Although dependents don't qualify for any stimulus plan payments, that won't apply in your case. You are too old and earned too much money to be claimed as a dependent, even if you lived in your parents home all year in 2007. The fact that they improperly claimed you and got their refund is irrelevant, and you CAN fix that!
Since they already claimed you, you'll have to file a paper return by mail to claim your personal exemption. The IRS will then contact you both to resolve the issue. They'll first ask one of you to file an amended return, dropping the exemption claim. (You stand fast at this point!) Then if nobody files an amended return in about 30 to 45 days the IRS will ask for proof of the claim from both of you. If you supply proof of your age and income, that will pretty much end the issue. Your exemption will be approved and your parents will get a bill for the additional taxes due. If that runs past April 15th -- a strong possibility now -- they'll also be hit with penalties and interest for late payment of tax.
Once this is settled, you'll get your stimulus plan payment, probaly a bit over $300.
Go ahead and file that paper return. You're entitled to it, your parents are not. They'll have to deal with the fallout of their improper (and illegal) actions. |

You can claim yourself - you'll have to mail in your return. Since you are 25 and made over $3400, they can't claim you in any case. You and they will both get a letter from the IRS telling you that two people claimed the same person, and that one of you needs to amend your return dropping the exemption. If your parents don't amend, then the IRS will step in and make the decision, and they'll have to pay back whatever they got by claiming you. |

File your return and in the box where it says are you claimed by anyone else - say no - include a note if you have to and tell the iRS, your parents were not entitled to claim you for 2007. If the iRS does its job correctly - they'll go back and get the money back from your parents and allow to claim yourself |

Page 10 of Publication 501 clearly states that your parents are NOT entitled to claim you (unless you're permanently and totally disabled) if you were not under age 24 at the end of 2007.
I would echo the advice of another answerer and encourage you to file a paper tax return. You might want to tell your parents that you're doing this and point out the table on page 10 of Pub 501 which shows that they cannot claim you. Perhaps they'll file an amended return on their own. If not, you'll have to show the IRS proof of your age and your income, and you'll then be entitled to your stimulus payment. |

No. You will not get a check. If you want a check your parents will have to ammend their tax return and return the excess refund. You will subsequently have to file a return. That would be the only way you would get a check. |

It may be best to advise your parents to file an ammended return (1040X) before April 15th, so they can avoid interest and penalty.
To be a qualifying child "The child must be (a) under age 19 at the end of the year, (b) under age 24 at the end of the year and a full-time student, or (c) any age if permanently and totally disabled. "
To be a qualifying relative "The person's gross income for the year must be less than $3,400. " (exception if disabled and sheltered workshop income)
There are additional requirements, like providing more than 50% of your support. IRS Pub. 501 already mentioned has all the details |

If you already filed and *didn't* claim yourself, then you will have to wait for 2008 to claim the rebate. The IRS is going to apply the rules bases on the original return filed.
At $12,000, your tax liability was probably $325--so your rebate would have been $325 as well. |
