You can claim him if he lived in your home for over 6 months and did not provide more than half of his OWN support.
Although the value of exemptions does fade at high income levels, your income is nowhere near that point yet.
With earned income of $40k you can't claim the EIC but you certainly claim him as your dependent. |

Unless you are separated or divorced from his father and there is a valid court order saying that his father can claim him, you can claim him as a dependent. If you are asking about claiming him for EIC, no you make too much money for that. |

yes, you can claim him regardless of your income. but you also have to make sure that no one else is claiming him (his dad possibly) and that you are not being claimed as a dependent of some one else (which i dont think you can do with your income) |

yes u should be able to even the father could claim him . Are you talkn bout on taxes, well u could claim him if u have been working long enough there,so if u r claiming him for taxes i take it u r not married for you guys to be claiming him or ur alone since u didnt say nething bout the father, but yes u could claim him, if u r w/ the father tell the father to claim or you could also have ur mom claim him and u get the tax money that way to. good luck |
