I'm not married to my partner, but we're buying a house together?

Thanks for everyone's advice about my personal life, but that really wasn't my question. I wanted the tax answer. My partner and I have been together for 14 years and have two kids. We're not concerned with splitting up.

Each person must deduct no more than either the amount that person pays or the amount that person owes, whichever is less. It is illegal for either person to deduct the full amount in any year, unless that person owes the full amount and pays the full amount. If each person owes and pays half, then each person deducts half.

Unless you are married I wouldnt do it. It causes so many problems later. If you do it though make sure both names are on it and the loan and you can both take 1/2 the deduction each year. By splitting it your itemized deductions may or may not be more than your standard deduction.

Never ever do that. There are so many pitfalls ya just can not list them but I tell you you could be in big trouble. Here is one..Let's say you split, he moves to England and stops paying and will not sign his half over to you....Who continues to pay? Who can not sell the house?

The answer is YOU!

Please read any book by Judge Judy before you are foolish enough to buy a house with someone you are not married too. You do realize that since you are not married you cannot go to divorce court to have them split your financials when you break up. Buy your own house.

How you can take title depends on the laws of your state, but usually the JTWRS is only allowed for married couples.

If your names are both on the deed and on the mortgage, then you'd split the deductions (mortgage interest and real estate taxes) in the same proportion as you actually paid them.

If you both own it and you both pay, then each of you can claim 1/2 of the interest and 1/2 of the taxes (assuming it's 50-50 ownership).

Follow the instructions in the schedule A to ensure that the one who doesn't get the 1098 gets credit on their taxes.

Talk to a lawyer in your town, as it veries from State to State. The lawyer can draw you up a mutual contract for Joint Tenenatship so neither of you can back out and leave the other unprotected.

Anyone can own property as joint tenants with right of survivorship but it is very unusual for it to be other than a married couple.

Personally, I would vote for tenants in common. That would give you the right to will the property to whomever you pleased: your children for example.

I bought a house with my then boyfriend. We owned it together for about 5 years before we got married. We owned it as joint tenants with right of survivorship and we each took 1/2 the deductions each year. When the tax forms came, both of our names were on them and we never had a problem with the IRS doing it this way.
