I am 16 and was working for 4 hours a week at Thorntons, i gave them my NI but got taxed around 3.40 per 4 hours (i was only on 4.20 ;[)

You are certainly wrongly on BR (Basic Rate tax code) which is normally used by employers for employees who have more than one source of employment income however is commonly used incorrectly by many payroll departments. BR is taxed at 20% of your income and if you worked 4 hours at £4.20 per hour equalling £16.80 then the taxable amount taken on code BR would be £3.36, even though your liability is £0.00 and should not have paid anything. Normal procedure would be to give the P45 (certificate of leaving employment) to the new employer however this will also contain the code BR and will more than likely result in the new employer continuing to operate the code. Filling out a P46 would solve the issue if still employed, however as this is not your first job in the tax year it can be very lengthy as it has to be sent to the tax office by the employer and can incurr monthly delays. The easiest and quickest way to resolve the problem if still employed is to ask the new employer for their PAYE reference and tax office telephone number if it is not on your payslip, which they will be happy to give you and call the tax office who will then resolve the matter by setting up your employment details (by completing the p46 procedure immediatelly via the telephone call) if they do not already have them and then issuing code 603L on a cumulative basis and your full refund of tax will be included in your next pay when the new code is used. This is a simple everyday procedure undertaken by the tax office and will resolve your issue very quickly.
If you are no longer employed you could resolve the situation by requesting a form P50 by calling the tax office (or downloading it from www.hmrc.gov.uk) which is a claim for in tax year repayment and will result in a full repayment of tax paid. If downloading the form and printing it off you would still have to call the tax office to get the correct address to send it to as it is rarely your local office.
Also, if you decide you will be going back to work termtime or at holiday periods and if you expect to earn less than £6035 over the tax year then ask any new employer for a form P38 (student declaration form) that is a form simply declaring you intend to earn less than your taxable personal allowance of £6035 and will allow the employer to deduct £0.00 from your earnings the complete duration of your holiday employment.
P.s it is a common misconception that students do not have to pay tax, however being in education in no way affects the taxability of income, generally in almost all cases a person can earn £6035 (the new annual personal allowance as of september replacing £5435 to compensate for the removal of the 10% rate band) equating to £116 per week over the fiscal year before being taxed irespective of education status. (based on 2008/2009 current tax year)

It sounds as if they have put you on Basic Rate - which means that you are being taxed at 20% on all your earning without being given any personal allowance.
Did you fill in a P46? You should have filled one of those which your employer would send to the tax office and you would then be issued with a proper tax code. Ring your local tax office and speak to them.
They really should have put you on a week 1 code if they were unsure what code to give you - as you are only 16, it's unlikely that you have already earned more than your personal allowance for this tax year.
Your best bet is to ring the tax office and explain what has happened. |

Talk to the tax people and the manager and get one of your parents to call on your behalf and help out if the manager seems to be treating you like you are being difficult.
We had one heck of a time with the first place my son worked and he was 16 and didn't want to make a nuisance of himself either, but you have as much right as anyone else to get things sorted out. The problems we had with his tax:
The tax department when processing his application managed to use a last name of mine that he had never had.
His work had his name correct, his birthdate wrong, claimed he lived in the same suburb as his place of employment, didn't know his street address and didn't seem to know anything about his tax number despite being given it.
It took my husband and I chasing son's work to get them to fix everything up. They didn't seem to pay much attention to him. |

sorry to say that no matter where you work or what age you are you will get taxed. You may however have the wrong tax code, check with your manager. if you are getting over taxed you will get it back |

Whilst I don't have my tax records here at home and even though you can look them up on the net i can tell you with absolute certainty that the tax you pay up to earnings of about $6100 or thereabouts will be fully refunded to you by the ATO (the tax dept) when you complete your tax return after the 30th of June next year. |

Hi if you are in the uk, under 16 and in full time education you shouldnt be being taxed, look in the yellow pages for your local tax office, have your NI number handy and they should be able to arrange a rebate :-) |
