I'm trying to find a law that requires my friend to pay an income tax & file a 1040... Could somebody help?
I know this stuff can get people a pissed... but really... I am trying to find this out as a friend has asked.

He said "show him the law that requires him to pay the income tax and file a 1040". I looked it up but I could not.

I showed him the Internal Revenue code book and he said "This is not federal law for one, this is the IRS code, and second, show me the law that states that I must follow the Internal Revenue code".

So I looked all it up, from tax protesters to the protesters of tax protesters and I could not find a single law to tell him.

I showed him the 16th, and he said "that just gives congress the right to tax". Then he repeated, "show me the exact law that says I must file a 1040 or pay income taxes".

So I've asked around and I get B.S. answers to this question. I've heard "Try it and go to jail". ... Ok.. That's fine but it didn't answer his question at all.

I don't understand why I can't find any law that requires a person to file a 1040, pay an income tax, or a federal law that requires every person to follow the internal revenue code.

Any help would be greatly appreciated.

EDIT: Same type of answers. irs.gov does not have anything like this.. They just have the irs tax code. I'm trying to find the law before that... The law that says you must follow the irs code.

You can read the actual laws passed by Congress in the U.S. Statutes at Large. For the most part, these are not available online. The current tax laws get the basic structure from the Tax Reform Act of 1986 which can be found in Volume 100 starting on page 2085. Various acts of Congress over the years since have modified that law to give us the tax laws as they are today.

The exact law that states a person must file a tax return is 26 USC section 6012. http://www4.law.cornell.edu/uscode/26/usc_sec_26_00006012----000-.html In simple terms, any individual that earns more than the standard deduction must file a tax return. Section 6011 states that persons liable for any tax imposed by Title 26 shall make a return according to the forms prescribed by the Secretary of the Treasury.

The IRC defines GROSS INCOME as ALL INCOME from whatever source... Taxable income is defined as gross income less deductions and exemptions. Section 1 of the code imposes a tax on taxable income. I'll say it again, the definition of GROSS INCOME IS ALL INCOME FROM WHATEVER SOURCE with some few exceptions.

Wages might be a trade for your time for their money, but that is not what determines a taxable amount. What does determine a taxable amount is how much money you have GAINED over what you had before. Working for a wage is a GAIN to you and is taxable as such. If you work a job at $10 an hour for forty hours and are paid at the end of that time, you have $400 more than you did at the beginning of the week. That is income and is taxable. A gain is defined as the difference between what you paid for something and what you sell it for. You paid nothing for your labor, so therefore, if you sell your labor for a salary, that is a gain to you. I would suggest to the rest of the community that we stop answering these silly "Show Me The Law" questions and hopefully they will just go trolling elsewhere. A 5-second Google or Yahoo search answers the question and it's silly for us to waste our time with these time wasters.

Go to www.irs.gov and look in Pub 17 under filing requirements. This will tell you if you have to file based on how much income you made for the year. However, I think you are stressing over somone elses problem. If he chooses not to file it will be on him.

But filing taxes is something all american's (who work) are required to do. I know you said you have heard about getting put in jail, but reneforce that your friend. I just hope he decides to file his taxes so he doesnot end up in jail ,which can easily be prevented if he files his taxes (which is easy).

Its all indirect. The 16th gives congress the power to tax. Bills have been passed to establish the IRS and give them the authority to administer the CFR. But you will not find any one law specifically directed to the income tax. That is what gives so many lawyers full time jobs and ample income, administering the tax laws. I have always objected to the "rule" that ignorance in no excuse for not obeying the law, because it allows lawyers to write laws that no one can find or understand. Yet they can convict you of not following.
