you dont actually file without your w2.

they offer you a loan (RAL) and once you do get your w2 they will file.

this is very expensive. i dont recomend it.

It isn't true.

Some preparers will prepare your return based on a pay stub, and some will give a high fee high interest loan for part of your expected refund, but they hold it and don't actually file it with the IRS until you bring in your W-2.

It's a scam. They give you a loan based on the estimation of what you'll get and then you have to pay it back. The interest on the loans can be pretty hefty.

Some tax preparers are advertising just that (i think I saw an H&R block ad).

They probably use your laset pay stub to estimaet a refund - the idea is not to file early but to give them a cahnce to charge you high fees for a refund anticipation loan.

Dn't do it. Those loans are a complete rip-off

You may be able to file in the second week on January. However, you should wait till you get all the Forms like W2s and 1099s. If you file based on last pay slip, you may have to file amended tax return if there is any different figure in W2 or 1099. Read http://taxipay.blogspot.com/2008/04/list-of-articles.html

If the W2 earnings forms and/or 1099s indicate taxable income and there are withholdings, the Income tax form must have copies of these at filing. What do you your W2s say ?

You can file based on your last pay stub, but that is risky in case there is a change in the amounts. The w-2 is the final information. H&R block will do it, but why pay super high interest rates, when you can wait and file around Jan. 31.

And don't get the bright idea that you'll just guess what your W-2 will look like and file anyway.

1. No professional tax preparer will file it because when caught, they will lose their ability to efile anyone's returns (putting them out of business).

2. The IRS should (but doesn't yet) hit you with a $500 penalty for filing a tax return when you knew you were doing it wrong. Yes, errors can be fixed, but the create huge delays and expense for both the IRS and you.

It's extremely common for the IRS to flag a W-2 claim as suspicious and then they'll wait until they get the W-2 from the employer (which is in MAY) to compare them.

Technically you probably could if you eFile, but your taxable income and deductions are often different on your last stub than on your W-2 to various reasons. The best you would be able to do is estimate what your taxes will be. I would never recommend actually filing with just that info.

That is very true...all you need is your last pay stub to know what you made for that year. You can also go online to H & R Block and see an estimate of your taxes. Click on Calculator. Hopes this helps!
