It depend how much you have if enough to get to another tax bracket you will have some in each bracket. Assuming you are in a 25% bracket you will have 25% for IRS and 10% penalty but you might also have state tax and penalty so I would assume it will cost you about 40-45% of your retirement money to donate to the IRS. This means you will need to save almost twice as much to replace it and it isn't growing while it is gone. While you are paying it back you won't be saving other money for retirement so besides the 40-45% you are delaying your retirement 10 years or so. |

It's taxed as ordinary income. The tax will depend upon your other income. On top of that is the 10% penalty for early withdrawal.
Keep in mind that if you're still employed by the sponsoring employer you normally won't be allowed to withdraw the funds unless you quit. And keep in mind that if you're not fully vested, the amount that you are entitled to may be much less then the total balance in the account. |

so i take it you cant get a personal line of credit from a bank? taking money form your 401k is like what you do to stave off bankruptcy
and to answer your question, after the 10% penalty, it is counted as income. or may be that's pre 10% penalty. one or the other |

You'll pay income tax on the withdrawal at whatever your rate is, plus a 10% penalty for early withdrawal. If you can help it, don't do it. |
