You need to correct your terminology. A tax return is something you file. A tax refund is something you get.
You won't get a tax refund if you didn't work and earn any money. Ifn this case, your parents can claim you and your child as their dpendents and get both a refund (if they had withholdings) and the earned income credit for your child since they provided your upkeep..
In order to claim your baby, you have to prove that you provided more than 50% of its support (this means a job). Since that didn't happen, your parents who provided support for you and your baby can claim both of you.
If they didn't do that on last year's return,(2007) you need to have them look into it. If it only affects the 2008 return, then they need to be sure to claim both you and your child.
If you didn't earn any money, you are not entitled to claim your child as a dependent since you didn't pay for its upkeep. |

There's nothing to refund, and if you don't have earned income, you aren't eligible for EIC - so no, you won't get a refund, unless you collected unemployment and had taxes withheld, then you might get some or all of that back. |

You don't "get" a tax return, you FILE a tax return. A tax return is the forms and schedules you file with the IRS (Form 1040, etc.) and your State tax authorities.
If you overpay your tax liability, you get a REFUND of the excess. It's the same as giving the cashier $20 for $5 worth of stuff at Wally World. You get $15 in change. That's ALL that a tax refund is -- change for overpayment.
Since you have no income and didn't pay in any taxes, you are not entitled to a refund. Having a baby does not get you "money from heaven" from the IRS, only a lower tax liability. Yours is already $0 and with no earned income you can't go any lower than that. |

You must have earned income in order to file a tax return, which means income you have earned by being employed.
Since you live with your parents and you have a child and no source of income, your parents are allowed to claim you and your child on their tax return as dependents.
When you start working and your income (for that tax year) is less than $3400, your parents may still claim you.
Remember this is all based on if you have absolutely NO source of income what so ever.

I feel so bad for your situation right now. But, if you made just a little bit of money and had some tax deducted, you could file for a return, and then you could claim some of the credits, and you could get almost all of the tax returned to you....
If you could find a part time job at least... |

You can order the 1040A form and instructions from the IRS. It will walk you through the form. You just plug in the correct numbers (dollars, children, whatever) and at the end you will either get something or not. It won't be a refund, because you didn't pay taxes, but it might be something. |
