I am being IRS audited ($2MILL) from 8 yrs ago, how to get old bank statements/etc that far back?

My husband is being audited from 2002. He was a building contractor for 30 years. In 2002 he had 20 pre-sold homes going up, unknowingly the Real Estate boom was hitting right around the corner

Materials unexpectedly went up, as we were in contract with with people. Soon we were paying more for the homes to be built than we got in return once they were completed.

My husband, being the sole provider for the family, sunk into a deep depression.
We filed for bankruptcy.

******Our main problem is that we don't have any bank statements, because of course our account closed up, and with all of this time elapsing, the bank is not required to keep them. The federal bankruptcy trustee shredded the information (we found out about 3 years ago)... They were searching for money and could not find any. Also my husband barely filed his taxes for that year and a few others in 2008.

The main thing is tracking down (AND SHOWING) where the money was spent. Of course I'll be hiring a real estate attorney, in the meantime, but for a Saturday evening I thought i'd see if any of you had anything as far as tracking down records/and this situation. Thank you =]

I dont have any paperwork because I gave it all to the federal trustee, and he's the guy who shredded it

No one is going to be able to help you on this forum and no one worth anything is going to be able to help you on a Sat afternoon!

You have weeks, if not months to respond. You don't need to the information today.

Hire the attorney and let them handle the case.

You have a serious problem. You should have books of original entry that show the check numbers and dates of the payments. I have never heard of a bank that didn't keep records for at least 10 years, usually 30 years or more. When I was a tax auditor we sometimes subpoenaed records that far back. You do not need an attorney unless you think you are in danger of criminal prosecution. Find a CPA or Enrolled Agent who who spent some time as an IRS Agent. He can help you for a much smaller cost to you than an attorney.

If your case is appealed to the tax court, you would need an attorney. He could subpoena the bank records.
