Maybe. Who paid the premium? If you paid the premium, the benefits are not taxable. If you employer paid the premiums, then the benefits are taxable. You can deduct any attorney's fees for taxable benefits as an miscellaneous itemized deduction. If you eventually get Social Security disability benefits they may be partly taxable.
