Since you filed jointly, you are both liable for the debt. However, since you are divorced now, you may be able to qualify for innocent spouse relief which is offered by the IRS. There are a bunch of criteria you must meet in order to qualify, but if you don't qualify for that you may also qualify for equitable relief or relief by separation of liability. File IRS form 8857 with the IRS if you think you qualify.

If you were married and it was a joint return you are equally liable in the eyes of the irs.

If IRS took your refund then it was because you had a joint debt with your husband, for a year you and him filed a joint federal tax return. So IRS took your refund to pay off a joint debt .
Call and find out how much more is owed and to check the balance, because if your X is not paying anything on it your rebate will also be offset and any future refunds will also be applied to the joint debt.

Contact IRS.
Contact X Hubby.
You should have filed seperately and IF you did they shouldn't have made you pay HIS debt! I would call the IRS FIRST. Hope this helps. From a Lady age 48 WITH an X Hubby also who we had to go through simular happenings. best of luck to you. By the way, I came out ahead with the X. : )

The IRS has stated that if there is a prior debt owed that is on your account then your rebate check will probably also be taken for this prior debt.

What kind of debt? Was this debt incurred during the marriage? How did you file 2007 tax return?
If you were divorced in 2007, you should have filed S or HOH, not jointly and this shouldn't be happening. Your EX's debt should not have been used to grab your refund, unless it's your debt too, at least in IRS' eyes.
