You can only claim him if your relationship does not violate any local law, you lived together for the entire year, and he did not make more than $3400.
See IRS Publication 501 for more details. Look up "members of the same household" or something similar. |

You cannot claim him as a dependent. If you pay someone to take care of him (assuming he is unable to meet basic needs by himself) so that you can work, you may be able to get a dependent care tax credit. But you do not get to claim him as a deduction. |

I don't think you can claim a live in boyfriend but please see a CPA. Your boyfriend may be on social security or disability benefits and you are not married. May I ask why you pay all the bills? He must be receiving something for his disability and that should go toward living expenses. If not, you must find him some financial help before you find yourself in a bin ed. |

I've been in the situation, and Steve's answer is correct. However, your b-friend's income must be under $3400. Go to IRS homepage; in 'search', type: 2007 Publication 501; click on 1st listing (it will come up in pdf format); look at Table 5, pg 10 (Overview of the Rules, etc.); look at 'Qualifying Relative' on pg 13; b-friend must meet ALL 4 tests (I suspect he already meets #1); read all the examples, especially 1 & 2 in column 3; MAKE sure tests 2, 3, and 4 are also met!
Use the worksheet for Support on pg 18. Also, you will not be able to file for Head of Household using him (see this on Table 4 higher up in form 501: 'Who is a Qualifying Person for............ HOH' ).
I really had to answer this one because I've been a "dependent" in this type of circumstance, and many people don't know this can be done. Steve's also correct regarding the 'not violating any local laws', by the way. Good Luck! |
