You sure can - you could claim your baby even if he was born the night of 12/31 as long as it was before midnight.

The best way to file will be a joint return. His pay while he's in a combat zone won't be taxable unless he's an officer. If you qualify for EIC, you can choose to include his Iraq pay for that purpose, although you won't pay income tax on it - only include it if it gives you a higher EIC, you get to figure it both ways.

Newborns can be claimed. If you haven't already gotten the SSN, file for it immediately.

The "most money" is if you file Married Filing Jointly.

You can always file a joint return even if only one of you had income. You'll normally pay the least tax that way. If you file separate returns you lose out on the EIC and other possible tax credits as well so it's usually to your beneift to file jointly.

You can always claim a child born at any time during the tax year, even if they're born on 12.31.2007. The normal 6 month residency requirement does not apply for a child who is born (or dies) during the tax year.

One further tip: Since he served in a war zone your filing deadline is no longer April 15, 2008 but is automatically extended for 6 months after his return. Unlike most extenstions this is also an extenstion of time to pay any tax due without penalty or interest. Just in case you have other things on your mind when he returns. ;)

BTW, tell him that this old Top Kick thanks him for his service. Been there, done that!

You can claim your child born at any time in 2007 on your taxes for all of 2007, if you are otherwise eligible (according to the same rules as if they were a few years older and your only child, except that the requirement that the person live with you for 6 months of the year does not apply if the person lived with you from the day the person was born to the end of the year, even if that time is less than half the year.) The only age minimum for claiming a child is that they must be born no later than the last day of the tax year for which they are being claimed. (You cannot claim a child with whom you were still pregnant at the end of the last day of the tax year for which they are being claimed, even if they are born before you file.)

You can claim the child as dependent. Be sure to have ssn for all dependents. The likelyhood is high the a joint return is best for federal taxes. However, if you have state income tax, see if it makes any difference. Check it out both ways. For example, the State of DE allows you to file married, separate returns, and does not charge a higher tax rate when you do it.

Yes, make sure you have a social security number for him. My youngest of 3 was born on Dec.7th 2006 and I claimed him for that year and got a bigger return. You should definitely claim him. And as someone else said, claim married filing jointly if you both worked. It is to your advantage as you will get more back.
