I am married with childern they dont have a social security number ,can i claim them on my return.?

No. According to the IRS:

If you file your return claiming your child as a dependent and do not provide their social security number on the return, the dependency exemption will be disallowed. You have two options. You could file your income tax return without claiming your child as a dependent. After you receive their social security number, you could then amend your return on Form 1040X (PDF), Amended U.S. Individual Income Tax Return. You have three years from the later of the due date of the return or from the date the return was filed to amend the return.

The other option is to file a Form 4868 (PDF), Application for Automatic Extension of Time To File U.S. Individual Income Tax Return. This would give you an additional six months to file your return; by then you should have your child's social security number.

Apply for the Social Security number as soon as possible:

I'm pretty sure you have to have SS #'s to claim someone. Double check with ur tax ppl.

chatsplas
NOPE.
Get them #s. The SS is pretty good, getting cards out in about two weeks. That's in plenty of time to file your 2007 returns. If they're not US citizens, you need to get them ITINs.

Yes you can claim then. If they are not eligible for SSN then you can apply for ITIN using the Form W-7. This is like a temporary SSN. Now if they do qualify for SSN then you can file your taxes and leave the SSN line blank. When you do obtain the SSN you can call the IRS at 1-800-829-1040 and give them the SSN. What they will do is called a math error adjustment. They will "fix" your tax return right over the phone. This is the easiest way to do it. If you file the amended return, the 1040x, you have to fill out a form and it takes the IRS up to 12 weeks to process it. The math error adjustment should not take more then a month.

Probably Not. Try to get SSN for them, if not eligible, then obtain ITIN (Individual Tax Identification Number) by filing W-7 with IRS. See the instruction below.

Grandpa
nope you need SS# for the children to claim them on your taxes because theirs have that info in their systems to double check your info SS# and your children's SS# within the system and if no SS# or wrong SS# they will kick out your return and red flag it so you need to get SS# cards for the children they are watching all returns for not having the right info

No but when they do have SS numbers issued to them you can amend your tax returns to claim any deductions, credits and EIC you are due

richard t
