You can claim an unrelated person as your dependent under the Qualifying Relative rule (yes, I know, it sounds wrong but it isn't) if ALL of the following conditions are met:

1. He or She is a US citizen or resident.

2. He or She did not file a joint return with another taxpayer.

3. He or She is not the Qualifying Child of another taxpayer.

4. He or She lived in your home ALL year.

5. You provided more than 50% of his or her entire support for the entire year.

6. He or She had less than the personal exemption amount ($3,500 for 2008) in gross income, excluding non-taxable Social Security benefits.

7. Your relationship is not illegal under local law, even if such law is unenforced. These are the states where it violates local law: Florida, Michigan, Mississippi, North Carolina, North Dakota, Virginia, and West Virginia. There are local ordinances against cohabitation in many other states though, so check your local laws first.

If she works 40 hours per week, she obviously busts on rule #6 above. Make a mental note to not take tax advice from whomever told you that.

Someone can be claimed as your dependent if s/he meets all five of the following tests:

Test 1 - Relationship
The person must be your relative, either by blood or in law. A person who lived in your home as a family member for the entire year can also be considered a dependent, as long as the relationship does not violate local law.
Test 2 - Marriage
The person cannot be married and file a joint return with her/his spouse.
Test 3 - Citizenship
The person must be one of the following:
* a U.S. citizen or resident alien, or
* a resident of Canada or Mexico, or
* your adopted child who is not a U.S. citizen, but who lived with you all year in a foreign country.
Test 4 - Income
Generally, the person's gross income must be less than $2,500. Gross income does not include nontaxable income, such as welfare benefits or nontaxable social security benefits (like SSI).
If the person is your child, s/he can have a gross income of $2,500 or more if:
* s/he was under age 19 at the end of the year,
* s/he was under age 24 at the end of the year and was a full-time student for at least 5 months.
Test 5 - Support
You must have provided over half of the person's total support (food, shelter, clothing, medical care, education) for the year.

Note: A person you claim as a dependent cannot be claimed as a dependent on anyone else's return.

This is false, you guys are not married, and if she is working she will claim herself on her taxes. The only way you can claim her is if she has not worked and if you have been supporting her. You cannot claim the same person on two differnet tax forms. Do you see what I am and saying? If she claims herself, you cannot claim her also.

You can only claim people who depend on you for support. Plus, doing something like that would be enough to establish common law marriage.

Doesn't matter if your married or single I claimed my girlfriend for 3 years. The only way you can claim her is if she doesn't claim herself and nobody else claims her. It doesn't matter if you make 50% more or less
make sure she didn't claim herself on her W4 because if she did and you claim her the IRS is going to send you a letter

I was under the impression that you can claim anyone as long as they aren't anyone else's dependent. Could be totally off though - talk to an accountant.

I think you have to be married to claim somebody. I could be wrong but I'm pretty sure on this one.
