If the proper paperwork has been filed by your local child support agency, it should be taken for the child support.
It's possible he hasn't had a refund for the last 7 years or so to be taken. He could just adjust his W-4 so he'd owe instead of getting a refund, and there wouldn't be anything to take (can't do that with the stimulus payment).
Sometimes local DA's get on the serious deadbeats (which $37K would qualify as) and haul them into court, tell them pay up or go to jail. Sounds like what you need.

do you have a formal written child support agreement that went thru court or some official state agency? is your child support agreement formally registered with the state? are his wages automatically garnished no matter where he works? If not - you may never see that money - get to your local domestic relations office or call the state child support dept and get registered

The tax refunds and stimulus checks are subject to garnishment. However, the state has to file notice each year with the IRS. Also, if the children are now adults, the IRS interceptions generally stop.

Actually no it wont...i called the IRS directly to ask the same question and unfortunately, since this is to be spent to boost the economy ur children are not part of that boost (that was the IRS guys exact words to me) but you should of been receiving his income tax checks due to back child support unless he is married or re-married then his spouse can file an injured spouse form when filing taxes in which ur state would not be able to touch any of the money or a lil bit of it towards child support. or he just may not be filing taxes at all..sorry!
