I claimed a child on my return without permission but he lived with me and his parents claimed him also. HELP!
i claimed a teen on my income tax return who lived with me the entire year and i took care of him . i claimed him on my taxes and got the money back already. i did not ask the parents if i could claim him because i figured they would not since i had the kid the whole year. i supported him. his parents claimed him and they denied them and told them somebody already filed. i didnt want to argue with them so i made up a story 00 about my taxes being filed automatically and i didnt know i claimed him, but i told him i didnt get money back cause i owed... she wants me to give her 500 even tho she did not take care of him. if she reports that i claimed without permission i could get in trouble because i have no real proof other then word of mouth... i do not want to pay her since i should be getting the money, but i am afraid i will have to pay the irs. what should i do

i forgot to mention that the child is an older teenn who is afraid of his parents. if the irs asks him where he lived he will probably say with his parents. even tho it was a lie. i claimed him on my last years return...will that help my case

You have the right to claim him. What address does his school records say? Who takes him to the doctor? I'm sure you have lots of proof of your supporting him. You don't owe the parents any money. It would seem to me if he lives with you and wants to stay there he would be willing to tell the truth if it comes to that. Since he is with you he should not be afraid of his parents. You are legally entitled to claim him.

So... you are saying that this child lived with you ALL year, that he made less than $3400 and you provided more than 1/2 of his support. When you filed, you did, of course, only claim him under the qualifying relative rules. (The QR rules only give you the $3400 exemption and nothing else.)

Let the IRS sort this out. The parents will have trouble showing the child lived with them for at least 6 months...and clearly they should already know that they can't lend or sell the exemption to someone else.

You did goof when you said you didn't know you claimed him. You gave them emotional proof that they can win over your claim.


Noul
obtain school letters, neighbour's testimonies, teacher's testimonies or any letter he received through year. Be ready when the IRS ask you proofs about your dependent.

Also no one cares what the little brat or his white trash parents have to say. Just show your receipts and you will be fine.

I would just file an amendment after you get the taxes back. You can try calling the IRS, they'd be able to advise you. Toll-Free, 1-800-829-1040

if he's a teenager, and he lived with you, you should have at least some evidence of it. I find it hard to comprehend that he would stay with you from January 1st 2007 until december 31st 2007 and then go back to his parents. Why was he staying with you? Was there trouble at home?

Your story gets even shadier when you say that you lied to his mother about it.

What you did was technically illegal if you have no proof that he was living with you. I can't see why you don't have it though. A year is a long time to not have proof that a teenage boy lived with you.

Call the IRS 1-800-829-1040 and tell them the truth -- all of it. Then, ask them what you need to do to correct your information and prove you provided support for this child.

if you really want to follow the letter of the law....neither of you can claim the child as a dependent.

the parent cant claim because the child must have lived with the parent for over half of the year...but the child lived with you for the whole year.

you cant legally claim the child because the child is not related to you (at least you didnt say if he was) and relationship is one of the tests to see if you can claim the dependent.

so, in this case, nobody may be able to claim the exemption. what happened here is YOU gave a gift to this teen.

its kind of like a boyfriend who supports his girlfriend and her baby...he can not claim either his girlfriend or her baby.

yeah , just file an amended return to fix this...dont fight it...you will lose and them maybe bring on the full wrath of the irs.
a few hundred buck is not worth the trouble.
