You can file them. Pull out the 2005 1040 form from the www.irs.gov website. Don’t forget to file your State return if you need too.

There is a statue law mentioning that you have 3 years from April 15 from the year due. Which means you still have time to file your 2005 return. Good thing that you think you will get a refund. If you would have owed money you would have a penalty and interest.

Go ahead and file them now. You can get the forms and instructions for 2005 at irs.gov - don't just use this year's forms, they won't be right for 2005.

If you have a refund coming, you'll get it and there won't be a penalty for filing late.

No, it's not too late at all. If you have a refund coming, you'll get it. Your have 3 years from the filing deadline for the return to collect any refund due. If you miss that, you will lose the refund. You need to file a paper return using the 2005 forms and mail it in. If you are due a refund, there is no penalty for late filing at least with the Federal return.

You can still file for three years from the due date, but you may face a penalty for filing late and if there's anything owed to the IRS. I just filed my 2005 return a few months ago and had about $350 in penalties. Taught me to get my act together this year (hired an accountant!)

You can go to the www.irs.gov website and when you click forms, you also can click for previous or past year forms. You can also ring the IRS if you have questions -- I was scared that I'd get a lecture about being late, but they were actually very helpful about what I needed to do and how.

Nope, not too late to do that. If you expect a refund, you have a 3-yr deadline in which to accomplish that. If you owe, there is no deadline & the penalties keep accumulating until you do so.

I'm not quite clear about your additional post, but if you believe that you didn't file your 2005 return based on the fact that you didn't get a tax package to file 2006 taxes, your rational is flawed. IRS is attempting to eliminate as much paper as possible, and most of us didn't get something in the mail (as we did in past years) that was a clue that we had filed taxes last year.

File the taxes for 2005. You will have to pay a small penalty for failure to file but you will not be penalized for failure to pay if you didn't owe any tax. You will also still get any refund you are due but, of course, you will not be entitled to receive any interest on the money.
