Yes, you can always file. I used to put off filing for 3 years at a time. (I hated dealing with it). As long as you don't owe anything, you will have no problem. If, however, you would have owed them last year, you will really owe them now.

Getting a tax attorney is a good idea, I have one, they are not that expensive. Mad max is an idiot, the IRS interest rates are not that bad, and they CAN give you penalties, but they don't HAVE to give you penalties- it is their option. |

You'll need to get the forms for 2005 and file your 2005 information on those - you can download them at irs.gov. You'll have to mail it - too late to efile for 2005. Do it as soon as possible. If you owe money, there will be interest and failure-to-file penalties, but they'll keep adding up until you file and pay what you owe. If you have a refund coming, you'll still get it and won't be penalized.
And don't panic - to the IRS, this is not an unusual situation.
File your 2006 return as you normally would. |

Get a tax attorney's help. A friend of my husband did this and he got into serious trouble with the IRS. Getting an attorney on day one of your troubles will save you allot of trouble in the future.
The longer you put it off the worse your situation will get.
