You still must file your tax return even if you do not receive your W-2. And if you are not able to retrive your W-2, you may use form #4852, which is a substitute for the W-2. You can pull this form from the IRS web site or by visiting your logal IRS center. Complete the form and mail it along with your tax return There may be a delay in any refund due while the information is being verified.
As these documents are essential to filing your tax returns and were to ever happen again, here is the process:
You should receive your W-2 from each of your employers every year. Employers have until January 31, (of the subsequent year) to provide or send you your W-2 for the tax year in question, either electronically or in paper form. You should allow two weeks to receive your W-2 from employers who send them by mail.
If you do not receive your W-2, contact your employer to inquire if and when the W-2 was mailed. If it was mailed, it may have been returned to your employer because of an incorrect or incomplete address. After contacting your employer, allow a reasonable amount of time for your employer to resend or to issue the W-2.
If you still do not receive your W-2 by February 15th, contact the IRS for assistance at 800-829-1040. When you call, have the following information:
Employer's name, address, city, and state, including zip code.
Your name, address, city and state, including zip code, and SS# and
an estimate of the wages you earned for the year, the federal income tax withheld, and the period you worked for that employer. The estimate should be based final pay stub oou received for that year.

Even if you did not get W2, you must report the income. For missing W2, you should contact IRS. With your information, the IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (Substitute for Form W-2 or Form 1099-R).

if you have your last stub - you can use that to file your return - include a note and give the IRS all the info about that company - name,address, etc - The IRS will put a hurting on them - They owe the IRS fines for not getting you the W-2 in a timely manner |

You could call the IRS and report this. If he actually filed a W-2 for you with the IRS they could provide you with a copy - odds are though that Mr. Sleazy didn't bother to file as he was required to. Were taxes withheld, at least for social security and medicare? Report him to the IRS - they'll try to track him down, and he'll be in major trouble.
One thing though - you said Oct 15 to "refile" your taxes. If you already filed your original return, filing an amendment wouldn't get a stimulus check even if you do manage to get the W-2 - the stimulus eligibility is based on your original return, not on amendments, unless the additional income is social security or combat pay. |

Since amending your return won't make a difference as per the stimulus, the real question is whether the missing W-2 causes you to have a filing requirement or an increased refund (otherwise you have no reason to file).
Since you didn't get the $300 in 2007, you will have to do the 2nd chance workhseet on the 2008 tax return. If you qualify for the $300 there, you would get it because you got $0 from the rebates. |

Visit your local IRS office for the wage information for 2007 (transcript of all your w2/1099 for the all of the filing year.)
You have until October to file your tax return not refile if you haven't filed, and if you did file then you will want to amend your tax return by filing form 1040X,
If your attempts to have your employer provide you with your w2 are unsuccessful and it is after February 15th, contact the IRS at (800) 829-1040. An IRS representative can initiate a Form W-2 (PDF) complaint. Form 4598, Form W-2 or 1099 Not Received or Incorrect, will be sent to the employer and a copy will be sent to you along with Form 4852 (PDF), Substitute for Form W-2, Wage and Tax Statement, or Form 1099-R, Distributions from Pensions, Annuities, Retirement or Profit-Sharing Plans, IRAs, Insurance Contracts, etc. The copy that the employer receives will advise him or her of the employer's responsibilities to provide a correct Form W-2 (PDF) and of the penalties for failure to do so. When you call the IRS or visit an IRS Taxpayer Assistance Center (TAC), please have the following information available:
Your employer's name and complete address, including zip code, employer identification number (if known - see prior year's Form W-2 (PDF) if you worked for the same employer), and telephone number,
Your name, address, including zip code, social security number, and telephone number; and
An estimate of the wages you earned, the federal income tax withheld, and the period you worked for that employer. The estimate should be based on year-to-date information from your final pay stub or leave-and-earnings statement, if possible. |

You need to amend your return to add this additional income to it. All income needs to be declared (even if it didn't help you get the stimulus).
To declare income that you didn't get a W-2 for, download, fill out, and attached to your 1040-X amendment the Form 4852. This form has you estimate how much you made and how much you paid in federal income tax, soc sec tax, and medicare tax so you can get credit for all of those and they income you need to get the stimulus. |
