Just be honest now; they have heard every excuse in the book, so don't give them any.They may be willing to do a deal with you, so make them an offer of repaying any money you owe. Be suitably contrite, and you will gain respect from them. And look, don't worry too much; it's not the end of the world. A good friend of mine was renting out two rooms in her house, and Revenue caught up with her; she was able to come to an arrangement with them that suited her. |

First thing to do is not panic.
Second thing to do is talk to the Revenue. Contact the office that sent you the letter and be as honest and open with all the information they ask you for.
The Revenue people are not monsters, if you talk to them and be as open as possible, and do not be rude or argue with them they will help all they can.
If you find yourself in an overpayment situation, they will first deduct payments from any ongoing claim you have. This might mean you will not receive any payments at all for awhile until the overpayment is cleared. If this puts you into hardship then tell the Revenue, they have a procedure for dealing with that.
If you do not have a ongoing claim, then you can ask for time to pay. Currently if the payment offer you make clears the debt within 12 months it will be acceted without further a do. If it takes longer than 12 months then you will have to provide details of the houshold income & expenditure, and based on the results of that a mutually agreed payment arrangement is made.
Although the Revenue can put a case into court and ask for custodial sentences it is EXTREMLEY RARE that they use this power. I have seen people owe a lot more than can be generated with a tax credit claim and they reamin out of prison, so do not think a custodial sentence is going to result here.
The important thing is TALK TO THE REVENUE.
Most interviews to deal with tax credits are now recorded, that is because a judge in another case has asked for transcripts of all communiactions on tax credit cases and this how the Revenue deals with that request. As one judge has asked for transcripts it automaically means that all judges require transcripts, and this is how the Revenue deals with such cases. It still does not mean you will go to prison. |

You will have to declare all income into the household, yours and your partner's, since he moved in. They will then see if you owe them any money back. If you do you, it will either be taken off your current tax credit or if that doesn't cover it, you can pay in monthly installments. Dependent on your total income it may or may not affect your tax credit. |

did you tell any other department? if you did then you might not get into trouble as they are supposed to share the information.
so long as you were not trying to de-fraud the system on purpose and you can show them this you might not get a record.
give them the info they ask for, be open and honest and work with them to resolve it. best way.
i know i keep saying it but they are just trying to protect taxpayers money from people who shouldn't be claiming it, and really we all should be grateful that someone does. |

depends what you've said to them and how long he's been there really, if you've denied it to them shift him out because they will know he's there, other than that apologise if it hasn't been too long and they will make you repay any over payment you've received, if its been a while then you'll be in trouble, i cant remember if they will stop your money for it if it's been long but they won't if its only been say a week, if it is only short amount of time apologise and declare everythin between you and they will be ok. There more interested in if you were planning on conning them or you just genuinly didn't contact them in time ok. |

The big question is what are they investigating?
If it's tax credits then you have a problem in that, were you claiming tax credits during the time your partner was living with you, you may have genuinely (or otherwise) not declared his/her income to the tax credits department.
If this is the case, be prepared to repay any overpaid tax credits you have received.
If you send them the correct details (they are not stupid or easily conned!!), they should be able to calculate the revised tax credit award and the total amount that is due from you.
I suggest you do so WITHOUT DELAY as this is what is legally required of you. Keep copies of all letters from and to you (it's much better to write than ring).
The Tax Inspector will write to you detailing what information they need from you and you should reply, WITHOUT DELAY, providing what information you can and giving a reason why any necessary delay occurs with any information you cannot then provide. (give them notice of what you have done to obtain any info you can't provide, and a timescale in which you will be able to provide it - again keep copies of letters as proof - you may be asked for them).
The big issue is whether they can assert you have been fraudulently claiming benefit. If so, and you can't prove otherwise, you are in the ****.
IF you are genuinely able to claim trauma (be prepared to prove this eg letter from doctor etc), and/or a number of other factors that would reasonably excuse both the failure to notify at the time, and the ongoing failure to notify since, then you may escape without penalty (other than the interest correctly chargeable on any overpayment).
The choice as to how you wish to handle this is entirely up to you BUT I recommend you are completely honest and truthful with them.

Sorry to hear about your unfortunate circumstances with regards to your question. As you are already probably aware any change of circumstances you must notify these people at the earliest possible convenience, unfortunately for you now this has gone a step further where they are now investigating you for this, you have to appreciate they are only doing there job so given the opportunity you need to tell all. I don't want to scare you, if this does go to court you may be given a Community Punishment Order, I wouldn't worry about prison I don't think it would go that far but there has been cases where people have been taken to prison.
Just try not to worry to much, it is easier said than done.

Good advice from all!
If you are going for interview that is to be tape recorded they will almost certainly "caution" you first if they "have reason to believe that an offence has been committed". THIS DOES NOT MEAN HOWEVER THAT IT WILL GO TO COURT.
Take someone with you and do not be pressurised into saying what you do not mean to. However you are likely to get more sympathy if you co-operate

This is a worry and hopefully you will be able to sort it out. It is always better to declare any change in circumstances as soon as they happen. My advice would be to tell them all the details now and hope that all they want is for the money to be returned to them |

I strongly suggest you decide to come clean and go to them voluntarily! You will be in the S***, but believe me its better than what else is coming! Apologies, Grovel, even cry! But get them off your back or you will never be free of it!
A prosecution will stay with you all your life! It can destroy your chances of moving on and upwards later!

i know- cant say. but be honest, if u have nothing to hide and it was a genuine mistake then u will prob owe them money back for how long u were living with your partner undeclared, your tax credit thresholds change when u are in joint claim and your household income. so u arent entitled to the money u recieved, but if it is genuine they will restart your tax credits in a joint claim and it can be backdated to when u moved in together, best thing to do call 0800 300 3900, but be aware they wont tell u anything about the case, but will inform u about the difference in single and joint |
