HI THE IRS HAS SENT ME NOTICE LETTER SAYING I DID´NT FILE MY 2009 INCOME... BUT THATS BECAUSE I HAVE NOT BEEN WORKING SINCE DECEMBER OF 2008. I MOVED OUT OF THE COUNTRY. I NEVER ONCE RECEIVE A LETTER OR ANYTHING JUST NOW. HOW AM I SUPPOSE TO FILE AN INCOME IF I HAVE NOT BEEN WORKING... OR DO I STILL NEED TO FILE ONE... AND HOW DO I DO THAT IF I AM OUT OF THE COUNTRY?

If you did not work, you had no earned income.

Without income, you pay no taxes, and without earned income you cannot qualify for the Earned Income Credit.

if you had no taxable income you cannot file taxes and you will not get a refund. the refund comes from overpayment of taxes and the tax credits for children like child tax and earned income credit are only for people that had a taxable income. there is no need for you to file taxes. the best idea would be to let your parents or anyone you lived with claim you and your child on their taxes to get the benefits and then they could give you some of the refund. its either that or let you and your childs exemptions and credits go to waste.

The key word is INCOME tax...you had no income....lol Yea file you get anything the IRS will hunt you down for filing false.

No, you didnt work at all, so there is nothing to file. But who was supporting you and your baby, well you can have that person claim your baby, all they would need is the childs social security # and DOB. And well if you were paying any kind of loan to the government such as student loans, you can file that and claim your baby.

That "someone" was wrong. If you didn't have any income, there is nothing to deduct from and no tax to take a credit against. They can only reduce your taxes, and with no income, yours is already zero. The two refundable credits, Earned Income Credit and Additional Child Tax Credit, are based on income - so no income, no credit available to you.

And as usual, about half of the answers you've gotten here are wrong. I'm not sure just why so many people who have no knowledge of tax law insist on posting their wrong answers - are they that desperate to get the 2 points?

If I remember correctly, you do have to file if you are able to work and not on disability (which is tax free), even if you do not have income for the year.

The only cases I've heard of that, however, were with married individuals filing jointly and the partner not working to receive the earned income credit and dependent credits...so if that's not your case...then I am not 100% sure how that works.
