You can file separate returns, but you MUST list your husband's SSN on your return. There's NO option on that, it's required by law. |

You will need to provide your spouse's SSN on your tax return, even if you are filing separately. Form 1040 asks for this information under "filing status." |

You don't have much choice but filing as married filing separately - you could file a joint return if you could agree on it, but that's your other option. But you do have to enter his ss# on your return if you're filing separately.
If you ever filed a joint return, his number would be on that. You could get a copy of a previous year from the IRS if you don't have one. |

you will still need hubby's SSN to file MFS. But in either case, you only need the SS number, not the actual card to file.
Married filing single is usually the WORST filing status. You may get stuck owning the government instead of getting your usual refund. Better you two should be civil and go MFJ. Then, when the divorce is final, file as Single.
You can file Single for this year if you were legally separated.
That would be better than MFS. The only time you want MFS is if your spouse has incurred huge debts and you don't want your tax return taken to pay his debts. Even so, the IRS allows you to file as 'Injured Spouse' to avoid his debts. Do a search on the irs.gov site for injured spouse form and you can download it.

You have to file married but separate because you are still married. Also if one of you itemized deductions, the other person has to also. The long form. Been there, done that. |
