I feel i was wrongfully claimed by my mother as a dependant?
I ffel i was wrongfully claimed as a dependant by my mother on her taxes. I live with her, but am not in school or have not been in school for about a year now. Her claiming me as a dependent makes me not eligable for the economic stimulus payment that most people are getting which is my main problem with it. there is no use in me talking to her about it cause she will make up a lie about it because she knows i dont know much about this kind of stuff. anyone have any adivice on how to go about this or if i can even do anything about it??

Her claiming me as a dependent makes me not eligable for the economic stimulus payment that most people are getting which is my main problem with it. there is no use in me talking to her about it cause she will make up a lie about it because she knows i dont know much about this kind of stuff. anyone have any adivice on how to go about this or if i can even do anything about it??

Since you are over age 18 and not a full-time student and earned over $3,400 in 2007 your mother can not claim you as a dependent.

You need to file a paper return claiming your personal exemption and mail it in. The IRS will then investigate the matter and decide if your mother was entitled to claim you. She will lose and the IRS will send her a bill for the extra tax that she owes, plus penalties and interest for late payment since it's past the April 15th filing deadline. You'll eventually get your tax refund and Stimulus Plan rebate though it may be late summer before you get it.

If you already filed without claiming your personal exemption then you will have to file an amended return using Form 1040-X to rectify the matter.

If you are 20 and were not in school for some part of at least five months of 2007, she can't claim you - you can file a return and claim yourself. She'll have to pay back what she got from claiming you. If you already filed not claiming yourself, you can file an amendment to claim yourself.

first of all she will only get payment for you if you are 16 or younger ,but if she supported you for at least half of last year she can take the deduction claim on you which it sounds like she done

i don't know about american law (presuming thats where you're from). but you didnt mention how old you are or whether you're working? if you are depending on her in anyway (financially or living with for example) then my guess would be you are her dependant so she isnt in the wrong.

I say just be happy that your mom is taking care of you and providing a roof over your head especially if you have not been in school for over a year. I wouldnt get all huffy puffy over the 300 or 600.00 that you wont be getting especially when rent alone is probably well over 600.00 for your mom not to mention food and such if she is supporting you. I cant get over how many people are so hard up for this money?

Unfortunately there is nothing you can do at this point to change your situation. Since you were claimed as a dependent on her 2007 tax return, and that is what they base the checks on, you're stuck. As long as she continues to provide for you (food, clothing shelter etc) you can be claimed by her as her dependent. Even if you moved out now and established your own residence, she could claim you for the 5 months you have lived with her so far.

You might ask if she would be willing to give you the $300 dependent credit she is getting for you. If you ask nicely and reasonably, she might surprise you.

just get your $300 from her when it comes,(rebate)and tell her next year not to claim you since you will be working. I dont know how that will work though being you are over 17. Dont get your mom in trouble by saying that just tell her to split 50/50 what she gets and dont claim you next year.
