I know that the "question" above wasnt really a question, but, I was just wondering if anyone knew when I would hear back from the IRS or what would happen? I had custody of them for more then half of the 2007 year which entitles me to be able to claim the child on my tax return. She claimed one of them illegally, so I wasnt able to. I was just wondering if anyone has had an issue like this or knew anything about the process. |

First of all, I'm assuming you paid more than half of the support for the child. Go to www.irs.gov and answer the 5 question test for dependence.
Now, if you are entitled to the dependent, you have to file an amended tax return to claim the child. (By the way, you should have claimed the child on the original - you can't efile, but you should have paper filed. When two people claims the same child, the efiled return will be rejected.) I had this same problem and all you have to do is send the paper work (custody papers) to IRS went they request it. If you don't file an amended return, IRS will not know that you are entitled to the dependent.
You should receive more from IRS than the cost of an amended return - and no, an amended return does not cause an audit. If a CPA filed the original, they will have to amended for you free of charge for their mistake of not claiming (if you told them too).

If someone else claimed one of your children, you "claim" that exemption by filing a paper return. This is the ONLY way that you can rectify this issue. The IRS will then automatically contact both taxpayers and gather information to resolve the claims. If you e-filed without claiming your child, you must file an amended return on Form 1040-X and claim the child. The IRS will not act on any other "claim" until you do this.
Once the IRS becomes involved, it typically takes a couple of months at least to resolve the issue, depending upon how quickly or slowly both taxpayers respond to their requests. If either taxpayer drags their feet, it can take several months to resolve. The winner gets the exemption and the loser gets a bill for the taxes due if their return has already been processed. |

What you should have done, if you were the one with the right to claim that child, is file your return claiming them anyway - that will jump-start the IRS investigation. If she had already filed, you wouldn't be able to efile claiming the child, but could mail in your return and claim them.
Did they ask you for proof that the kids lived with you over half the year? They should have asked both you and your ex for that. |

What do you mean by "filed a claim?" In order for the IRS to begin an investgation you need to file a return claiming the child or amend a previous return. Have you done either of these? If so, it's a rather long process--several months, at least. This is because the other party is afforded the legal right to prove they can claim the child and the IRS is bound to certain time frames. |

Does divorce decree specify who gets to take dependency exemption for children? Is so, that controls. If not (very unusual), custodial parent has priority over non-custodial parent. IRS will ask both parents to provide proof of custody, copy of divorce decree, school enrollment, proof child lived with parent.
Presumably, you submitted a paper return rather than filing electronically, and the additional information so the IRS could make a determination as to how to allocate dependency exemption between you two. The IRS handles many of these claims every year. Suggest you contact them by telephone Toll-Free, 1-800-829-1040 to find out the status of the inquiry. Be prepared for some hold time, and have all relevant info with you. It can take a few months, but by now you should be hearing something. |
