I get child support for my son. He will be 22 on jan 5 2009?
But he will not graduate college untill may 2009. The divorce papers state "child support will continue as long as he is in college but not beyond the age of 22 years" do I have any options? does the child support law compensate for unusual circumstances? like this.it doesnt seem fair that his child support should stop before he graduates.its not his fault he was born in the start of the new year. do we have other options?

I wonder if the person paying the support isn't counting the months when he can stop.

The judge probably put the "not beyond 22 years" to prevent your son from being a "professional student," staying in school to receive support, basically forever.

Life isn't always fair. Your chance of changing the court decree is slim. Your best bet is to learn to live without the additional income.

You're out of luck -- this should have been negotiated as part of the divorce.

Maybe appeal to the generosity of his father?

It stops when he's 22 - period. This was something you should have thought of at the time child support was being negotiated.

Sounds like it was detailed, so not likely that you have any options. His birthday hasn't changed since the order was issued. If he had become disabled or something like that in the meantime, there might be room to request a change.

Well, he is 22 all year long, does it expire just before his 23rd birthday? It is unusual to get child support that long. You are lucky to get it at all.

hes 22 so i believe even if he hasn't graduated you child support will stop. maybe you can talk with the father and make a plan of action to help with the college costs for the next year as it is both of your responsibility to help

You have a divorce agreement and will have to live with it. Do you really expect to change it after the fact because you've decided that "it's unfair"?

Not beyond age 22 means exactly that. All you can do is ask that the other side continue to help.

If you read it properly you'll see it's likely to be worded different.
Possibly "that such payments may not extend past the date that the child reaches the age of twentytwo" as that is the wording that's used in such cases so that people like BUgz's girlfriend won't have a leg to stand on (with all respect to her! lol)

If you had said what state you were in, I'd have tried to point out to the same law the judge was referring to.
Child support beyond 18 should be made illegal if you ask me as by definition an 18 year old isn't a "child" any more.
Here's the closest I could find to it, it stops when REACHING age 22 in missouri

But yes, you both have plenty of options, like get a job.

BTW Bugs, if I told you that I am going to retire at 65, would you assume I'd retire on my 66th birthday? Hope not :)

i dont think so unless the father agrees. in order to receive it, he has to be in college, but once hes over 22 then you wont get any more. I guess they think that he should have started at 18 and graduate within four years, which would make his age 22.

what doesn't seem fair is the father paid money all this time and had no say in the child's life and the mother who was the only parent able to influence the child's life was only doing her duty to help the child succeed in life.

At 22 I had been working 5 years already, and studying.

to BUgz: "not beyond the age of 22 years" means that when he'll be 22 years and one minute he'll be beyond that age and so no more eligible.Time for the kid to smell the coffee .

The divorce papers state not BEYOND the age of 22, he will be 22 for 12 months... the wording "not beyond" means he can't collect it BEYOND the age of 22, menaing he can't collect it when he turns 23. If it had stated UP TO 22, then it would end on his 22nd birthday.

The way it reads, the child support will be collected until he graduates in may of 2009.

The child support can be collected when he is 22 and in college, that is the way it is worded.

To Northern Lights: In a legal document the words "Beyond the age of 22" means until he turns 23. My fiancee is a corporate attorney.. I asked her before I answered this question. If the mediator intended for the child support to end on his 22nd birthday then it would have read "not beyond his 22nd birthday"

In legal terms, you are 22 for 12 months. My girlfreind agrees that the document is worded badly, but definately states that "Beyond the age of 22" means until he turns 23.

Oh, and she was laughing at the person who has been practicing for 20 years and stated that it ends on his 22nd birthday, and she laughed at you for stating that you are only 22 years old for one minute.

If I told you that you couldn't get paid beyond 2008... would you really assume you would stop getting paid On january first, 12:01am 2008? Beyond 2008 means January 1st, 12:01am 2009.

Beyond 22 means when he turns 23...

To the original poster, you will collect until he graduates, if the father attempts to terminate before than, get a lawyer and show them how the document is worded.

Valhalla.. if you said you wanted to retire by the age of 65, at the age of 65, or on your 65th birthday then I would assume you were going to retire when you turned 65. BUT, if you stated you hoped to not be working BEYOND the age of 65, then I would assume you don't want to be working when you are 66.

Also, if you go to the National Conference of State Legislatures, you can see the child support termination laws for each state, there are states that child support is paid to the age of 23 if the child is in an education institution. Also what you will find is that ALL states that terminate child support at age 22 use the wording " TO age 22", NONE of them use the term "beyond the age of 22". HOWEVER, if you do a search on Conneticut's termination law, you WILL find it written:

"Termination of support at 18, or when child turns 23 if enrolled full time at post-secondary educational institution.

The court may not enter an educational support order for post-secondary education beyond the age of 22 unless the court finds as a matter of fact that it is more likely than not that the parents would have provided support to the child for higher education or private occupational school if the family were intact. "

Now, since we know their law is TO age 23, and they later use the phrase "beyond the age of 22" then we atleast know that Conneticut deems the phrase "beyond the age of 22" to mean... TO age 23.

I can't find a single state that uses the phrase "to age 22" and also uses the phrase "Beyond the age of 22".
