Reporting the income would get your employer in trouble because by paying you under the table he is not paying his portion of your taxes. You could claim the income as being self employment income, but you would have to pay self employment tax on it which is WAAAAY hefty. (One of the things I think should be changed in our income taxes.) |

You can report your income as if you were an independent contractor without getting your employer in trouble. Use a Schedule C-EZ to report the income. You'll have to pay self-employment taxes on this income (about 15%) in addition to regular income tax. Both taxes will be added together on your income tax return.
Usually, an employer pays half of these taxes and the other half are deducted from an employee's pay check. You may want to hit your employer up for a raise to cover the 7.5% that he isn't paying. |

You won't get them in trouble, and won't be in trouble yourself if you report the income on schedule C or C-EZ and file that with a schedule SE and a form 1040.
You are letting them cheat you though, since you'll end up paying some of the tax they should have paid. Also, you aren't covered for unemployment if you get laid off, or for workers comp if you get hurt on the job. |

You would have to find a way to report it as self employment income in order to keep from getting into trouble and getting your employer into trouble as well. If you don't file taxes, you may be investigated or audited, but if you do and you say he pays you under the table then he (or she) will be in trouble. |

Declare the income. The IRS may or may not track it down to him. If they do, so what? You didn't rat him out. You only obey federal law and declared all of your income. You didn't make him become a criminal, he did. You know he is not paying you under the table so you can have tax free income. He is doing it to avoid the costs of having employees: social security, medicare, federal unemployment, state unemployment, workers comp, etc. He is screwing you. Why do you care about him? Besides, it is unlikely that your return will cause him to be audited anyway.
And think of this? What if he is audited for some other reason? Your wages are deductions for his business, so he is going to tell the IRS about everybody he paid under the table. Then they look at your return and see no income declared and guess who is in trouble now! Give him up because you know he will give you up when it is his turn. |

You may and are legally bound to report all income you receive whether or not you get a W-2 or 1099.
Employers have been known to send a 1099 at the end of January when the employee wasn't expecting it. You won't get the employer in trouble and you will keep yourself out of trouble. If your employer has not been withholding taxes, then it is possible they will send you a 1099. If you are truly an employee as opposed to an independent contractor, they should be withholding. I am not here to preach. Please report it on your taxes. Good Luck |

Depending on the size of the company, a company can pay up to $600 as contract labor per employee without reporting it. I use to own my business and used that alot for temp work. |
