Generally, your marital status on the last day of the year determines your status for the entire year. You are considered unmarried for the whole year if, on the last day of your tax year, you are unmarried or legally separated from your spouse under a divorce or separate maintenance decree. So you must file as Single. See the links below.

Sure. If it's a tax benefit to do so, and you're sure that who ever the refund is mailed to will split the difference fairly, then go right ahead.
