He's not physically with me. When I was married to my first husband we supported his family in Mexico and were able to claim it because we provided at least 1/2 of their support. It's been a while though and I'm not sure if the tax laws changed.

Go to www.irs.gov in the top right cornor put it itin and get him an itin number. Then file married filing joint. He is not counted as a dependent but as a cofiler. Then your deduction is $10700.

i would not see how you could claim him if hes not living under your roof and is not a us citizen with no ssn. why dont you go be with him instead of sending our us money over our boarders! ugh!

Your husband does not have to live with you. But if you get either a SS Number of an EIN (from a form W7) you should be able to file as married filing joint which in the long run is better than trying to claim him as a dependant.
By the way you can have a dependent who is a resident of Canada or Mexico. But you do need SSN's or EIN's

It is illegal to claim husband as your dependent in your tax return, if he is not physically present in USA.

No you cannot claim your husband he would have to be living with you under the same roof for at least 6 months out of the year,and he doesn't have a social security number to claim him any way. Why don't you file for your husband so he can get a green card and become a United States Resident.

My husband is American and I am Canadian. We got married 7 years ago in Canada and have currently moved to the U.S. I heard I can work under his Social Security number until I get one (which takes 3 months),is this correct? Thanks for your time :)
