You don't have to claim together but you may want to for the tax advantages. You can get married on Dec 31st and claim married filing jointly. Look at the results from filing both ways and determine what's best for your situation. |

Whatever your marital status was on the last day of the tax year is considered your marital status for the entire year. If you got married at any point during 2006, you are considered married for tax purposes so you can't file as single or head of household. This leaves you with the option of filing as married filing jointly or married filing separately. In most cases, you will get the most benefit from filing jointly. |

You can file Married Filing Jointly or Married Filing Separately.
If you file separately, you have to follow your state's laws on how much income is his and how much is hers. Mathematically, you will NOT come out ahead filing separately. The only reason for filing separately these days is non-math reasons, like: spouse has a prior tax debt, etc.
If you are in a community property state (TX, CA, LA, NV, WY...) your refund will be processed manually, so allow an addition 1- 6 weeks for your refund.

No you don't, but, usually filing together allows you further tax breaks and may save you money in the long run. Figure out your taxes both ways, then take whatever saves you the most money. |

Yes you file married filing joint. because by law the government says that your filing status at the end of the year. Even if you got married on Dec 31 you are considered married. |

Your choice.
You can check either married, filing jointly OR
married filing separately.
There should be instructions about partial years.
Many people figure both ways, and use the method that is to your advantage. (Then probably stick with it each year, or change only occassionally, when other matters change.) |

My husband and I were also married this fall.
I used TaxSlayer to run the numbers for us to file jointly and separately. It was more advantageous for us to file jointly. We owed a few hundred less that way. |
