If you do not receive a W2, the IRS suggest you estimate the information and file anyway. Then you amend the returns when the data is made available.

If you live in a Hurricane katrina or Rita area, the deadlines were extended to October 15 for last year and this year.

It's no problem unless you are going to owe money.....

If you are going to break even, then wait till next year if you want to. Otherwise file now.

Your W2, by law, had to be in the mail and postmarked by January 31st. Therefore, I don't think the IRS is going to want to hear your story. You need to find a good accountant or tax lawyer and get this worked out.

no. have to file & should have forced employer to give w-2 EARLIER by reporting them to IRS. Could have filed extension to Oct 15 so all on you for not filing.

File the return now. You will have to pay a penalty for late filing, probably $100. But file now. If this happens again, you can file your return without the W2, by using a Substitute W2 form and the information from your last paystub. Always keep paystubs, they come in handy in tax situations.
