By not paying your current tax, you have defaulted on your previous installment agreement. You will have to renegotiate the payment and, trust me, you are not going to like it. You will have to have your 2008 taxes paid currently if you expect any consideration from IRS.

First, you may think you have a plan, but when you default on a future (last year and this year's taxes) the payment plan goes into default. So, you don't have a payment plan.
You might try reading Pub 594 available at IRS.gov. That explains basically all your options. Your option to "do nothing" will get, at a minimum, a tax lien on any property you owe and a levy on your bank account and/or employment.
If you want another installment agreement, with your level of tax debt, you will need to fill out a financial statement 433-A. They may refuse you.
BTW, if you send a letter along the lines of Johndoe's, expect a visit from TIGTA (treasury police, and they carry guns), possible significant fine, and possible jail time. Not a good idea. |

You need to pay and pay until you satisfy the IRS. Until then they will be on your case, scrutinizing your returns, etc.
You owe, pay them off ASAP. And most of those companies are a rip off. . . the IRS will give you a payment plan without anyone else intervening |

You must pay and meet the payment schedule. Once you default, interest rate will increase and it will keep on multiplying. |

You should absolutely try to pay it off. A payment plan is a start. That said, you should also consider an Offer in Compromise, which involves negotiating your tax debt with the IRS to settle on an amount less than what you owe. As long as you are on a payment plan, you will accumulate penalties and interest which will result in 2 things: (1) increase the total amount you have paid significantly and (2) many years of payment to the IRS.
I would speak with a tax resolution company that will help you file an OIC. One company I am familiar with that does good work is Advantage Tax Help. Their website is www.advantagetaxhelp.com. Good luck! |

You need to continue to pay and work out a new plan for this year/prior year. If you stop payment, you can go to jail! Failure to pay taxes is a criminal offense that can lead to imprisonment - not just additional fines and penalties. |

If you have a payment plan, and stop paying, the IRS will act to immediately seize any assets you have, and proceed with further collection actions.
By abrogating an agreed upon plan, there will be no further delay, no more negotiations, nothing. Expect a court date soon if you go this way. |

Send them a letter stating that you are refusing to pay it. Please see the sample letter below:
Dear Sirs:
I recently received your letter stating I owe you agency $35,000.00. I am refusing to pay it. This is your notice to quit sending me anymore letters. Anymore letters from your agency will result in dire consequencess to you and your agency. This is not a threat only a warning. Please note I have the money available but am refusing to give you the amount due because I am sick and da**** tired of you idiots taking my money. Please refer this letter to the appropriate parties. Thank you in advance for taking care of this matter. Unless I receive a reply by December 8, 2008 I will take this as acceptance of my offer to pay your agency nothing. Have a good day.

Please note all the letters making the IRS out as some kind of monsters are untrue. If you send a letter like the one above what most likely will happen is the agent who receives your letter will get scared and go into his/her computer and without much fanfare change your balance to 0.00. If you do not believe me at least give it a try. |
