to all you jacka@@'s.....this is the first i have known about this.....the state took it upon themselves with me not knowing about it,...nothing in the mail,...no wage garnishment...nothing!

OK , I'm not going to be rude, I will answer your question. You can file injured spouse for you wife, if had any sort of income at all last year she will qualify for earned income credit. I would call your local H&R Block to ask these questions. There are different circumstances to why you haven't paid child support so I'm not going to judge you, and the EIC is for the children you have now shouldn't have to pay for your debt. Look into this soon before your return gets processed.

If you have a court order again you for child support, count on the the child support enforcement agency to get any refund check before you do. It's a wonder they have not tried to garnish your wages.

Yes, the form that you fill out is the 8379 Injured spouse form. It takes 8-14 weeks (closer to eight if you have already filed). She will get the portion that is due to her. The IRS decides this once they have processed the form, so you wont knw how much she is due. I am sure you can pay HR Block but the form is one sheet and easy to fill out. I became deisabled and defaulted on a school loan, since have married and had to file this form on my husbands behalf last year

How could this possibly be the FIRST you have known about this?
Did you assume that your son or daughter just started needing food when this notice came?
YOu married a woman with four kids so you should know first hand how much children need, did you ever once stop and think that your OWN kid might need some of those things too?

Why would you encourage HER to file injured spouse....If you let the IRS take the full refund, that is less money that you will end up owing (and going to jail for if you don't pay).
Since you take care of her FOUR kids, this is the cost of doing business!
She should not be crying about 'her' money when I am certain thatyou use YOUR money to take care of her four brats.
PAY it with the entire check.
IF she does not like it
kick her out or move

That's what happens when you don't pay when you're supposed to. I bet it hurts more this way.

Sorry if I seemed rude but you made it seem like you haven't been paying. Good that you clarified it. Like another poster said take to a CPA or H&R Block. Someone certified and more qualified needs to answer this because it's so complicated. You almost never win when it comes to child support and them taking your wages and returns.
