I have an unemployment question?
I was terminated from my last job for not punching out for one shift and for using the internet. They made me sign two written warnings for it, but when I asked for a copy they refused. Anyways I filed for unemployment and I got a letter today that says my employer claims the reason for my termination was attendance issues.

I never received written or verbal warnings about my attendance- can I fight this?

Having been in a similar situation, you must understand that its in the company's best interest to NOT have a former employee file for unemployment compensation since their premiums will go up on the rest of their employees.

So, what you do is make an appointment with someone down at the unemployment office and challenge the decision. It's an oral interview; you basically need to tell them the truth ~ that you don't know why you got fired. Yeah, you forgot to clock out once and yeah, you got caught using the internet (only because you didn't know the policy, or you were on your break, or whatever good reason you can come up with)...but that attendance absolutely was never an issue. You can go on to say that you got a warning about forgetting to punch out and a warning about the internet use, but you have no ideas what on earth they are talking about when it comes to your attendance since you've never missed a day of work, were late, whatever.

The unemployment office will contact your former employer for a clarification, to which you'll get a chance to respond one more time.

It's definitely worth fighting for because you will need that unemployment while searching for a new job.

If your 2 offenses are listed in your employment manual that you were given at your time of hire, then they are considered termination for cause. Most companies will fight for denial of claims of unemployment, because it increase their state unemployment insurance.
You can fight it, but if they are like most companies, they dotted their i's and croseed their t's, and they will prevail.

Yes you can fight it - and often employers assume that you *won't* fight it. They might back down rather than go through all their paperwork to prove your firing was justified.

The not punching out might be what they're considering an 'attendance issue' but with just one warning (assuming you got only one) I don't see that they have much to fight with personally.

You can try but probably wouldnt get far. They would just turn around and fight the internet issue.

I think they will rule in your favor and you should recieve full benifits they had no just cause too fire you and plus they put the wrong reason on the written warning even if they rule against you you should win by appeal
