I claimed for incapacity benefit but do not qualify because I have not paid enough N.I. contributions, apart from income support, housing and council tax benefits, is there anything else I can do? UK answers only please. Additional Details I'm getting treatment for possible bipolar, but its not bad enough for disability, the thought of going back to work at the moment makes me want to scream, but I will have to if I don't have enough for my family to live on. |

Why were you off sick? If you have a disability i.e oesteo-arthritis, then maybe you can claim disability living allowance. See your doctor and then put in a claim, your citizens adviser can help you fill in the forms.Hope you sort something out soon. |

You should contact your HR Department and ask for any outstanding holiday pay to be paid to you. You may also want to consider returning to work part time or in a different role, by law your company should be making reasonable adjustments to get you back to work. Have you received any home visits by occupational health, as they do a have a duty of care for your well being. In addition, if you illness is work related they should be able to extend your sick pay. Finally what was the start date of your employment, as your sick pay may kick back in on this date. go and see your local disability support group - shaw trust are a great company based across south wales and the west, they may be able to help.
You also may be able to appeal, get support letters from your gp and any psychotherapists/specialists that your seeing.
Also citizen advice may be able to shed some light on the subject and hand you out some correct advice. |

Ty Income support, Can you not go back to work. has your Company not got an Occupational Health department, If they have contact your managers and ask if you can be referred even if you are not fit to return to work full time they will be able to help you to make a start with a phased return to rehabilitated you back into your work place. ask the benefits office to talk to Action for work who help dick and inured people return to work |

Hi there - is your company monitoring your sickness. Why are you not receiving sickness benefit from them? Thats a bit strange.
If you feel that you have to go back to work, contact the HR department and they can facility a phased retunr back to work. If you have an occupational health department they will be involved.
Also ask the question ,why have they stopped it. The country is full of people claiming benefits and a can think off a few that are not geniune cases.
Demand answers - you deserve it due to your condition regardless if your illness is not a recognised diability |

Difficult to give a specific answer as the nature of neither your illness nor your work is known. It may be that although you can't perform your present job role, you could perhaps perform another role if your employer is able to accommodate you. Either that, or some short-term adjustments could be made to your present role that would enable you to return to that job. Employers should always be working to get their employees back into the workplace; if you're part of a large company, I assume your HR or Occupational Health Dept have been liaising with you. If you're with a small company, perhaps you should talk with your boss. If the company is unable to make adjustments, or offer you an alternative role, they may have no alternative but to fairly dismiss you due to Incapability, ie., long-term or persistent illness makes it impossible for you to do your job, but this cannot be done without firstly carrying out the correct procedures. (And we don't know whether your illness is work related, which would certainly affect the way your case is dealt with). Visit the second website below for more info re dismissal, plus further links to useful sites, eg., ACAS. At present, another option would be to appeal against the decision not to pay you Incap. Benefit. From the first Government website below: 'You may be able to claim Incapacity Benefit even if you haven't paid enough National Insurance contributions if the following apply:
1. You're aged under 20 (or 25 if you were in education or training at least three months immediately before turning 20)
2. You've been sick for 28 weeks
3. You're present and resident in Great Britain for 26 weeks in the year before you claim.
If you're refused Incapacity Benefit or have questions about your payment, you can ask the office that dealt with your claim to look again at their decision.'

I sypathise whole heartedly with you my friend.
I have been of work with a Herniated Lumber Disc. I can hardly walk and as I drive for a living, well, I can't.
I get SSP (pathetic as it is) and after 4 weeks, still waiting to find out what I am getting, income support or incapacity benefit.
I know that you are entitled to Income Support and that is topped up with Child Tax Credits (if you have kids, that is)
Dont do what I did. I never declared that I was off work to the Tax Credits and now they have stopped payment and now I owe THEM!!! (which is confusing as I earned less??)
