You would not give her a 1099 for Alimony, there is a line on the 1040 to claim that as an adjustment to income, however if any of the 1,000.00 that you give her is for child support you can not use the portion that is for child support as it is not deductible on the Federal Tax return. If your divorce agreement states that you are required to pay her 1000.00 per month is spousal support then you can claim the adjustment on line 31a of the 1040along with her SS# and she is required to claim it as income on her return on line 11 |

It depends on why you give her the money. If she is doing some sort of work for you, then yes. If it is alimony then there is a separate line for you to enter ssn and amount given. It must be court ordered or you cannot claim it. That would be considered a gift. Be careful about using your business to be vindictive. You do not want the IRS looking into your nooks and crannies. |

Go to page 124 of Publication 17(IRS) and read. In general if it is alimony then you can deduct the money from your income and it should be reported on her return. Enter the amount you paid on line 31a and her social security number on line 31b. Also read Publication 504 Divorced or Separated individuals. |

no need there is a line on the income tax form that asks about alimoney...put the dollar amount in there and she will get a nice note from the IRS saying she owes money for that untaxed income or they will grab her refund for the total tax dues. The IRS will get her and your Karma will be in tact! |

If it's paid as court-ordered alimony, you can deduct it, she has to claim it as income - there's no 1099 involved, so you don't have to mess with that. If it's child support, then no, it's not tax deductible. If you're just being a nice guy by paying it and it's not court ordered, it's not tax deductible, it's a gift. |
