I have heard you only need to file taxes if you owe money, is that true?

No, that's NOT true at all. You are required to file a tax return if your income exceeds the filing requirement amount for your filing status and the source of the income. That can be as little as $400 for self-employment income.

See IRS Pub 501 for a full discussion on filing requirements and stop listening to people who don't know what they're talking about. Here's a link: http://www.irs.gov/pub/irs-pdf/p501.pdf

While it is true that the IRS will not press the issue if they think that you don't owe anything, you can't know for sure where you stand until you prepare your tax return AND send it to the IRS. If it includes things such as capital gains, the IRS only has partial information and will assume that you owe them and act accordingly if you fail to file.

Note to DoomDiva: Check with your CPA again. It's NOT $600, but $400! You're confusing the requirement to file a Form 1099 for certain payments with the self-employment filing floor. The two are NOT related.

No, it's not true - if you have income enough to be required to file a return, you are legally required to file one by the deadline.

But if you have a refund coming and don't file or file late, there is no penalty.

About 5 years ago I didn't file a Vermont state tax cuz they owed me money, and the part year resident form is a real pain to fill out (moved that year).

About a year ago, long after I forgot about it, I got a bill from a California collection agency for like $700 for the taxes owed.

When the state figured my taxes owed, it did not even
consider the amount they already took in by withholding taxes, which showed them owing me like $20, and when I called them about it they said they don't factor in payments (ie withholding) until the returns are filed.

So, even if you don't *Have To* file, your better off just doing it in the long run.

I would still fill them, just in case the IRS picks up that random search and audit you. You don't want to give them any reason to double-check their work.

Jimmy
No it is not. Everyone who had income is legally obligated to file a return. Every year, people claiming federal income tax is illegal come out with a series of claims, this is one of them. If you do not file, the IRS has no limit on the years they can get you for it. The IRS can charge fines for not filing. If you don't owe money, you probably are due a refund, and that's the only way to get it.

Malcolm Equis
You do need to file whether you owe money or not. But I would think you would want to do so anyway. You can't get a refund if you don't give them the proof (by filing your tax forms) that you are owed a refund.

No. This is not true information that you heard. I am assuming that you were employed or you ran your own business in 2007. Call or write to the IRS or visit the IRS web site at www.irs.com. Take a look at Publication 17. It is pretty clear and in plain english, not legal speak, what is required to meet the requirement to file a return. If you don,t file a return you will not get your refund nor the stemulus check. I would file a return even if I did not have any income.

Ben O
nope, every citizen and non citizen who earned income in the US must file taxes regardless of wether or not you made enough money or you owe taxes.

Otherwose the portion who do file set the budget for next year and therefore the government continues to increase spending and taxation.

doomdiva
According to my CPA, you do not have to file taxes if you earned less than $600 from a single job, including working for yourself or as a sub-contractor. However, I am unsure if that would count for people who bounce around from one temp agency to another.
