Your gonna need to give more info than what you gave to even get close to answer.
I was just in a similar situation with my daughter and my parent's where they had legal guardianship, but they couldn't claim her as a dependant. |

Did he live with you more than half of the year and not provide more than half of his own support. If not, did you provide more than half of his support for where he did live AND he is not the qualifying child of another taxpayer. If yes to either of these two you can claim him. |

If he lived with you for over half the year, yes you can claim him as a qualifying child assuming he meets all the other rules. If he didn't live with you for over half the year, no. |

Did he live with you for more than 6 months in 2007? If so, then you can claim him as your Qualifying Child. If not, then you probably can not.
Legal guardianship does not matter to the IRS, only PHYSICAL custody. |

Only if the parents are not eligible to claim him. It is not sufficient for them to decide not to claim him. If they can claim him, you cannot, whether or not they actually do claim him. |

Yes, if he lived w/you 6 mos or more during 2007 and also if noone else can claim him. His parents will need to fill out a form stating they won't be claming him as their dependent. |
