Unless you have a very high income, it's likely that you were actually OWED money for many of those years.

On behalf of the Canadian taxpayer, I thank you for giving us all that extra cash over the years.

However, if even ONE of those years you owed money beyond your normal deductions, you have a whopping tax and fines bill waiting for you. You have also been committing a crime.

I once did this for someone who hadn't paid in 10 yrs: go to CRA and ask them for tax forms for the last (however many) yrs. They may only be able to give you photocopies of some of the older ones. Fill them all out, and see where you stand. There is a statute now that limits how far back you can claim refunds, and they no longer pay interest from the original date you should have filed, but you should still have some money coming back, reduced by any late fees and fines you might have accrued as well.

If you are ever audited, which I think you will be... they can back-track your taxes for 10 years. You should have claimed & paid like the rest of the "free" Americans.

I suggest soap on a rope. Good Luck in Prison.

IF you did not owe the government anything then you do not have to file. If You did owe them money, boy, you are in some serious trouble. They add late fees, penalties, etc., etc., etc.

I forgot to declare something in 2006 and ended up owing them $1400 but by the time they brought it to my attention two months ago that $1400 had multiplied to $3400. I think the interest is compounded by the minute!!!

If you are like 99% of the people, an honest taxpaying citizen who has a mental block about paperwork, I think they will understand and not throw the book at you. If they wanted more money from you, they knew where to find you. You can go on for years without social security or medicare. We will all die sometimes right. However if you are the 1% scumbags, who don't pay their taxes or are purposely cheating the taxing agency, then wait until its time to retire, turn yourself in and get 3 hot meals and a cot at the Sing, Sing retirement home.

You have to file a tax return.
Even if You know that You have paid too much, and would get a refund.
If You go to the authorities and throw Yourself at their Mercy, You just may not go to jail.
Good luck ! I think You will be happier and less stressed when You finally get it sorted out.

I'm surprized that the taxing authorities had not caught up with you. I don't know about Canada, but there is a statute of limitation of tax return filing. It's 3 years in the US. Find it out in Canada. Go to a professional chartered tax accountant or tax attorney and have them prepare your tax returns for the years you have remaining. In the US, you would be filing the current tax year 2008 and preceding 3 years 2007, 2006 and 2005.

Since you had paid in taxes every pay period, chances are that you might be required to pay only late filing penalties for the 3 preceding years. If you had taxes due on some of these years, you could end up paying penalty as well as interest on the amounts due.

Do the right thing and remember to do it every year. If you don't want to do the preparation yourself, pay the pro who prepares for you.

Depending on how much you have taken out of your check (the max amount?), how you file (single,married filing jointly,head of household, etc.) and whether or not you have any exemptions (children or dependents) or deductions, the IRS could owe you money. It's kinda doubtful considering you would have to pay penalties for not filing all those years. But the longer you wait, well....it can only get worse. If you have been having taxes taken out of your paycheck all these years, I'm surprised you haven't been caught up with already. If they come after you, they can make it a lot worse on you than if you voluntarily try to fix the situation. You need to consult a good CPA. Go armed with proof of earnings and deductions for all those years as well as photo ID and SS cards for everyone that will be on any one of those returns. I don't know about Canada but in the US they would only go back so far.I have to tell you though, you should know and trust this person in case you decide not to file after all, but I highly recommend you do so ASAP.

I assume that IF they audit and IF they decide that your claim is false, they'll recalculate your tax, charge you the difference between the old and new returns + interest + a fine for lying.

I would gather everything that I have and head straight for a cpa. My bil hadn't filed for about 5 years and it all balanced out. You don't want this hanging over your head and you could be missing out on some money owed to you.

You could be arrested, but it is more likely that you would be fined, since taxes are being deducted. This does mean that they are being reported to the IRS and I am shocked that they haven't caught up with you already. How was the deduction set up with your employer? If you are claiming deductions that you don't actually have, for example you don't really have 3 children, you could owe a significant amount of money.

The question is, if taxes are being deducted, why didn't you just file?
