Maybe! It all depends on if IRS filed returns for you (SFR-Substitute for Return) for older years or not. If they did and claim you owe, you may want to correct them by filing an original 1040. If there are no SFRs, you may be allowed to file just the last 6-7 years. IRS will probably not bother you for the others under current policy. As a matter of law, IRS can demand any un-filed tax return no matter how old be filed; but under Internal Revenue Manual policy, since the late 90s they have taken a position on just requiring the last 6-7 years be filed. This is to promote voluntary compliance. Good Luck.

Yeah they only let you go back 5 years unless of course you owe money then they go back as far as you want.

Have you been receiving letters from the IRS all these years that you owe them XXX amount of dollars?? Or were they just sending you letters telling you to file? It could be that you would have been due a refund all those years and that's why you don't have this hugh tax bill that they would have been hounding you on. But the problem is not that you didnt pay or owe taxes, it's that you didn't file. That's what sent Al Capone to prison, not that he owed taxes, it was that he just didn't file one. I would contact the IRS and ask for a transcript of income earned statement for the past ten years. If you see that you would have gotten a refund when you file them. well pal, you lost out. The IRS will only refund money back three years from the year the return was due.Meaning anything that was due to you before 2003 has been forfeited. If you do owe, then the IRS will go back 10 years and start adding interest and penalties from April 15h 1997. But my guess is that if you haven't been receiving threatening letters saying that you owe them a lot $$$$$$$ of money, then you were probably due a refund. The IRS just wants you to get back into the system, so go ahead and get the transcripts and start filing. Be patient, this is going to take a year or so to get straigtened out.

If you have not filed in 12 years, but have been working that entire time on the books, the companies you worked for would have been reporting to the IRS. As soon as you file, it will trigger the non-payment for those years and you will be hearing from the IRS.

Your best bet at this point is to go see a tax lawyer and explain the situation. If you simply try to avoid it, they will catch up to you and it will only be worse.

You are liable for taxes in all 12 years. Since everyone knows they are required to file, this is not a simple oversight, it would be considered deliberate. Therefore the Statute of limitations will not apply at all. They can go all the way back.

If you had w-2 withholdings, and may have been eligible for a tax return, you won't get any. If you owed them money, now you owe them penalties and interest.

You probably need a tax lawer. Consult your local bar association referal service.

Unless you are under suspicion of fraud or criminal activity, the statute of limitations may apply.

Check with a good tax accountant, don't take chances with the government types.

No, not really. If you have income from earlier years that you haven't filed on, you need to do that. The IRS can go back any length of time if you didn't file - the statute of limitations doesn't start until a return is filed.

It is IRS general policy stated in its manual that it will only solicit six years worth of delinquent tax returns unless fraud is suspected. If IRS has made assessments of earlier years based on information it had available, you will have to file a correct return to get it adjusted.
