I haven't filed my tax return for the last 4 years, what should I do?
I'm positive that I do not owe any money for taxes, and would've gotten a refund each year if I did file. My income for each of the last 4 years was under $40,000.

I'd like to try to fix this mess this year, and get back on track. What's the best way to do this? (I can't afford a lawyer)

WELL file oldest returns QUICKLY. IRS will only give you refunds going back 3 years. April 15 will snuff out another refund for you.

Income at that level REQUIRES that you file, but if a refund is due, there will not be interest and penalties that you face if you owe. You don't need a lawyer, you need a tax preparer or tax software. You can use free efile at irs.gov for this year's return. Many of those sites also have prior year returns.

Only current year returns (2007) can be electronically filed, others are paper returns mailed in. Gather your stuff and get it done, year by year. You'll feel so good once you've done this. Block and Jackson Hewitt can do past year returns and take walk-ins and appointments.

Your first priority is to file your 2004 taxes. You must do so by April 15th, 2008, or you will lose your refund for that year.

You don't need a lawyer. You might need the help of an Enrolled Agent or CPA or an experienced tax preparer....even H&R Block is fine if your tax return is straightforward and you've got your records together.

You can still purchase prior year copies of turbotax, but like I said, you better get on the ball for 2004 return.

You don't need a lawyer. If you would have gotten a refund, you aren't in any trouble and don't owe anything - you can just file now for those years, and you'll still get your refunds for 2005 and 2006, and if you file by 4/15/08 you can get your refund for 2004 also, after that it will be too late.

Find a tax preparer who is an Enrolled Agent.
Expect to pay between $100 to $150 for each year's return.
But get them filed as IRS will eventually look at the W-2's submitted by your employer and if there isn't a corresponding tax return showing your exemptions & deductions they will assess tax & penalties as though you had no exemptions or deductions.

Since you are already so late you might as well schedule an appointment after the April 15th so that the preparer will have time to spend on your old returns. They are going to put current returns and returning customers before you.

If you are indeed due a refund for those old years you will still get your refund, but only for the 2005, 2006 & 2007.

Well. the first thing you should do is file the past tax due tax returns. If you are due a refund you will still receive it for the past three years. The IRS doesn't have to receive it before the 15th of April...it just has to be postmarked on or before that date.

Next, you don't need a lawyer or even a CPA. Both of them are over rated. I am an Enrolled Agent (EA), meaning that I specialize in taxation only. I had a very good practice for many years fixing CPA's and Lawyer's mistakes.

Many people think that a CPA is a tax expert; well, most of them aren't. They are basically auditors that provide a certified set of financial statements. A CPA and a EA take a 16 hour test. Each test is very hard, but a CPA's test only has one section on taxation. Where, the EA test is only about taxation.

Now to be fair, I do know a few CPA's that are very good at taxation. But, that is their speciality.

Want to know a secret...most CPA's don't prepare tax returns, they hire someone else to do it for them. If you don't believe that look at the classified ads around October or November.

File the returns. You can get forms and publications for the years in question from the IRS web site.

File your 2004 return first. If _received_ by the IRS before April 15, you can get your refund.

If you owe money for any of the years, the IRS will calculate interest and penalties, and sent you a bill.

Just go back and file them! You can contact IRS to get the prior years' forms. Or, if you want to contact me, I could help you, if you like. The sooner you rectify the situation, the better off you will be!

You do not need a lawyer. A CPA would do well.

You could check the IRS website. They may have a FAQ section that would deal with this problem. You may want to take all your paperwork to a tax preparation service and have the help get you back on track.

The simple answer is: file your returns. It isn't clear from your question why you have not done so or think the process would require a lawyer. Or even an accountant. If you made $40,000 a year, but think you do not owe, that leads me to believe you are an employee. (A self employed person with an annual income of $40,000, who has not filed returns in years, would almost certainly owe money.) If all you have is wage income, filing the returns will be a cinch.

File your returns, file 2004 first so you won't lose your refund if one is due to you by April 15, 2008 (postmarked).
Only if it is too complicated and you can do it yourself you should then go to a CPA for assistances in filing.

It is better for you to file now than for IRS to send you a letter (ASFR) telling you they will file the returns for you, which if IRS files for you they will file single, 1 exemption and standard deduction. You will then owe if IRS files for you.

Contact IRS at 1-800-829-1040 and let them know you are filing, and to check that IRS is not in the process of sending you a letter to tell you they are going to file for you.
